June 6, 1977 <br />The regular meeting of the Everett Board of Adjustment o�as held at <br />7:30 p.m, i.n �he City Hall Council Chamber, City Hall, Everett, <br />Washington. <br />Mr. Baird presided; Mr. Russell, Mr. IIlack, and Mr. Krist-iansen <br />were present. Mr. Berg was absent. <br />A hearing was held on the application oi Fobert Champion, 1712 <br />Pacific, Everett, �9A, 98201, for a variance froni Section 18.20.050 <br />E.M.C. (Everett Municipal Code), Paragraph C, Rear Yard Requirc- <br />ments, for permission to build to within thirteen (13) feet of the <br />rear property line rather than the code requirement of twenty (20) <br />feet. <br />Also, to project with a cantilever four (9) feet into t-he rear <br />yard setback. <br />LEGAL DESCRZYTION: The N. 15' of Lot 28 and all of Lots 29, 30, <br />31, and 32, Bloc1: 3, Climax Land Co. lst Add. <br />to Everett <br />ADPRESS: <br />ZONING: <br />3802 Colby <br />R-4 idultiple Fami.ly Fiigh Density Bcsilenca <br />t•ir. There are exceptional circum>tances ap»lying to the <br />suUject property as to the i.ntended usc thercof', that <br />do not appl.y generally to other propertics in tiie same <br />vicinity or zone. <br />2. Thzt such variance is necessar.y for the preservat:ion <br />and enjoyment of a substantial property right of the <br />appellant possessed by the owners of other n+-�pert-ies <br />in the same vicinity. <br />3. The authorization of the variance will not be mat:erially <br />detrimental to the public welfare or injurious to property <br />in ihe vicinity or zone in wh�.ch the proper.ty is locatel. <br />4.
