MAR-20-19% 16:27 EV CLINIC ADMINISTRATION 206 339 5405 P.03 <br />March 19, 1996 <br />In an effort to work with the Everett Clinic and senlc our concerns, we have worked <br />through the items that are of primary issue with regards to the proposed main campus <br />expansion construction project The following is a summary of the items we would like <br />to have the Everett Clinic agree to. <br />1. The Everett Clinic agrees that as part of its main campus expansion project <br />construction process, it will demolish and remove the existing house at 3918 lloyt and <br />make improvements to the property to allow for 12 new parking stalls as depicted on <br />exhibit 1. These improvements will *afro inciode appropriatelailibCapin$ and <br />developement of a grern belt area. ingress and egress to the new parking stalls shall be <br />guaranteed sad maintained by the Everett Clinic. The Everett Clinic shall assume <br />responsibility for securing the necessary permits and approvals to accomplish the <br />aforementioned improvements and demolition. The Everett Clinic will, at their expense, <br />assume responsibility for all removal of any hazardous waste materials or underground <br />storage tanks on the property. <br />2. The Everett Clinic agrees to jointly submit a mutually acceptable master signage <br />proposal to the City of Everett for approval. When approved, the new signage for <br />Physicians Eye Clinic will be provided at The Everett Clinic expense. There will be two <br />primary Physicians Eye Clinic signs included in this proposal; one sign on corner of <br />Rucker and 40th St and one sign at entrance to the parking area off Hoyt. See exhibit 1. <br />The signage on Hoyt will include directions for Physicians Eye Clinic parking area. <br />3. The Everett Clinic agrees to indemnify and hold harmless Physicians Eye Clinic for <br />any and all costs, expenses, fees and property, personal injury and death damages, arising <br />from the Everett Clinic's permitting, construction or maintenence of the new facilities, <br />including the implementation of this settlement agreement, and it is aWced that the <br />h.%crctt Clinic will not seek to vacate the southern portion of the alley which is adjacent <br />to the Physicians Eye Clinic. The Physicians Eye Clinic will bear no cost in any of the <br />alley vacation process. <br />4. The Everett Clinic agrees at its sole expense to relocate utilities from the alley ' <br />bordered by Hoyt Avenue and Rucker Avenue between 39th and 40th Street and repave <br />the current alley portion and parking area directly west of Physicians Eye Clinic.
