Flndinps: The applicant states that the aubject propeRy hes <br />unique dreumstances regaraing the locatbn of the buibi�9 � <br />the subjed site and an existing non�conforming afgn shucture. <br />The subject property has an existing freestending sipn that is <br />considered nonconformi�g with regards to height. This sign <br />was construded in 1953, and later remodeled and replaced in <br />1983. At that time the Ciry approved the sign to a heighl of 24 <br />teet wilh no setback from the property line. The sign was <br />construded in accordance wifh all pertnit requirements in <br />effect al the time. <br />Due to a street widening projed, the applicant is ptoposing lo <br />relocate the sign 15 feet north ot its curtent locatfon on sile. <br />The sign area and height will remain the same, however lhe <br />new sign will only be setback 2 feet from ths east end west <br />property lines rather than the required 9 Y:• The applicant has <br />stated that due to Me irregular shape oi the lot, and lhe <br />location ot the exisNng strudure on afte, the propo�ed location <br />of the sign is the only possible area for a sign on aite. The lot <br />is triangular in shape measuring 75 feet wide along lhe south <br />property line, and narrowing to 10 feet wide across the north <br />property line. In order to maintain any visibility of the sign it <br />needs to be located as far north on site, so that lhe existing <br />building does not block the sign. <br />b, Co�cluslons:. Tho existing structure was conshucted prior <br />to zoning code standards coming into eftecl, and therefore lhe <br />structure would be considered legat nonconfortning related to <br />setbadcs and height. The applicants proposal for the setback <br />variance and sign height at the proposed sotback are <br />necessitated by the unique featurea of the site, in partiwlar <br />the location of the existing building on site, as well as the <br />ircegular shape ot the lot. The new sign will actually be <br />moving towards wnfo;mance, by providing for some setback, <br />rather than the zero setbacF: it has existing. The proposed <br />location o( the siQn takes into account the limitations of the <br />site, while still providing for visibility of the sign. All other <br />aspects ot lhe sign will be in compliance wilh current code <br />requirements. <br />
