� <br />CHhrion No. 2: <br />That the variance will not be materially detrimental to the praperty in the <br />area of the subject property or to the City as a whde. <br />a. Flndinps:. The proposal is to relocate an exisdng sign to a <br />new location on site. The wrrent sign extends into the <br />Evergreen Way right-of-way; the new location would provide <br />for a two-foot setbadc from both the east and west property <br />lines. By relocating the sign to the proposed IocaUon the sign <br />is adually moving towards conformance with regards to <br />height. The subject site is surrounded on three sides by <br />public roadways, and therefare the proposed sign locatlon <br />should not be detrimentat to any adjacent properties are the <br />City as a whole. <br />The City provided written notice to all property owners within <br />300 feet of the subjed property and no comments were <br />received. <br />The City of Everett Publ�c �Yorks and Building Departments <br />had the opportuniry to review the proposal. The folbwing <br />comments were received: a) A building pertnit is required fw <br />the new sign. b) The sig� shali be located entirely within the <br />Totem's property envelope. No portion of fhe sign may <br />overhang the public right-of-way. <br />b. Coneluslons: By relocating the subject sign, the site is <br />moving towards confortnance with the standards established <br />in the zoning code. There are no other signs immediately <br />adjacent to the proposed sign location. The proposed <br />variance shouid not be materially detrimental to the <br />neighborhood area or the City as a whole. <br />CrlNrlon No. 3: <br />That the variance will only grant the subject property the same generel <br />rghts enjoyed by other property in the same area and zone as the subject <br />property. <br />a. Fi�dlnps: By allowing the new sign to be relocated on the <br />same site the applicant is enjoying the same rights of <br />neighboring properties and businesses, by allowing <br />themselves some fortn of public advertisi�g. <br />Evergreen Way is hosl to numerous businesses that have <br />freestanding signs. Many of these signs do not meet the <br />currenl zoning setback requirements. <br />� <br />5 <br />
