(exhibit 1) <br />A property owner within ihe area submitted an objection to the increased height of <br />the proposed garage claiming ihat it should be limited l0 18 (eet in height. The <br />witness (Dewdney) submitted in wriling that other structures within ihe area are <br />smaller, and the proposed garage would be larger than any on ihe alley between <br />9th and 101h Slreets. He contended that there would view obstructions, the garage <br />would be out of scale with lhe house, and it would have a"derogatory impact on <br />surrounding homes". The correspondence was received prior to lhe date of the <br />original hearing scheduled for May 12, 2005, which was not held due to notification <br />•�rror. The hearing was rescheduled and re-adverlised. (exhibit 6) <br />At the I�earing, a representative of the Applicanl identified lhe subject property on a <br />photograph thal was admitted as exhibit 2. She also identified lhe property of the <br />compiaining wilness. Based on lhe depiclion of the properties in exhibit 2, il does <br />not appear thal the proposed garage �vould biock any views or would be oul of <br />scale of the struclures in the area. (Davis testimony) <br />10. No opposition other than exhibit 6 was submitted. There was no lestimony or <br />evidence on the aesthetic impacl to the surrounding properties or on the impact of <br />the neighborhood character. (Ingalsbe testimony) <br />1 t. The aulhor of exhibit 6 submilted photographs thal attempted to depict the <br />reasonable height of garages in lhe area. However, no scales were drawn, and the <br />submitted photographs are nol demonstrative of the fact lhat is trying to be proved. <br />No persuasive testimony was submilted lhat ihe characler o( lhe neighborhood <br />would be changed by the requesied exemption. <br />Jurisdiction: The Hearing Exarniner of the City of Everett has jurisdicfional authoriry to <br />hold a liearing and to issue the decision. That authority is set forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the Hearing Examiner enters the (ollowing <br />Conclusions: <br />CONCLUSIONS <br />The Aprlicant requesled approval of an exemplion to the requirements of EMC <br />19.7.020.H. It is the inlent of lhe Applicanl to construcl a 762 square foot detached <br />garage to a maximum height ot 21' 4" on property localed at 915 Rucker Avenue, <br />Everetl, Washinaton (subject property). Because EMC 19.7.020.H restricts the <br />lieight of accessory buildings (detached garages) to 15 feet, the Applicant is <br />seeking an exception pursuant to the provisions of EMC 19.7A20.K. jfinding 1) <br />EMC 19.7.020.H establishes ll�e maximum height of accessory dwellings as being <br />15 feet. The Hearing Examirer of the Cily of Everett c�n provide an exception to <br />Ihis s�andard pursuant to the requirements of EMC 19.7.020.K. (finding 1) <br />3/ <br />
