The factors such as view obstruclion, aesthetic impacts on surrounding properties, <br />and impact on the neighborhood character have been considered in lhe review of <br />ti�is proposal. There was no testimony or persuasive evidence that there would be <br />any view obstructions created by the consiruciion of the detached garage. Further, <br />there does not appear to be any aesthetic impacts on surrounding properties or any <br />impacts on the neighborhood character. (findings 6, 8, & 9) <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions and testimony and evidence <br />submitted at ihe public hearing, it is hereby ordered Ihat an exception to lhe height <br />standards for an accessory building (a detached garage) on property located at 915 <br />Rucker Avenue, Everett, Washinglon, is granted subject t� the following conditions: <br />A covenanl acceptable to the City Attomey's office shall be recorded on the liUe lo <br />tlie property slating lhal the property owner acknowledges the requiremenis of this <br />seclion, and stating thal Ihe use of any accessory structure is fimited to accessory <br />aclivities permitted by the zone in which lhe property is located, and that lhe <br />accessory building shall nol be converled to living area or used for any purposas <br />which are not in fuli compliance wilh zoning and building code requirements. <br />Z. Obtain necessary building permits (rom the City of Everett's Building Department. <br />Compliance with the State Building code is required. <br />3. The maximum heighl of the garage shall not exceed 21'4". <br />The garage's siding and roofing material musl be compalible wilh the existing <br />dwelling. <br />5. The garage must have a roof pitch similar to the existing dwelling. <br />6.
