BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE NO. 35-88 <br />Based upcn the written request for a variance from the City's <br />zoning code by: <br />Marshall Batchelor <br />2714 Saratoga Lane <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant," for a variance from E.M.C., <br />19.42.040 (B), Front Yirds, which requires that decks and porches', <br />in the front yard are allowed but only if they are less thane <br />forty-two inches high and have no roof covering to allow the) <br />existing front porch to be covered and a deck constructed that, <br />will be eight feet high and extend into the front yard areal <br />approximately four feet. <br />on the property commonly known as 2714 Saratoga Lane <br />The Board of Adjustment, following a public hearing on said <br />application held on November 7, 1988, and further having reviewed <br />all testimony, makes the following Findings, Conclusions and <br />Order: <br />That there have been exceptional or extraordinary) <br />circumstances or conditions applying to the subject <br />property or as to the intended use thereof that do not <br />apply generally to other properties in the same vicinity <br />or zone. <br />a. Finding: The subject property consists of an existing <br />single family structure on a 12,275 square foot lot. The <br />existing house does not meet front yard setback since it <br />is only 42 feet from the center line of Saratoga Lane <br />instead of the 55 feet required by code; however, it is <br />25 feet from the front property line which is the normal <br />front yard setback in the R-S zone. <br />The existing home is a single story structure with an <br />uncovered porch on the front. The Applicant is proposing <br />to construct a second story on the home and as part of <br />that construction to place a roof covering on the porch <br />and also construct a catwalk on the second level that <br />would extend an additional four feet into the front <br />setback area. <br />The Applicant wishes to cover the porch in order to <br />provide an aesthetically pleasing design, provide a safer <br />entry as the entry way currently is exposed, faces north, <br />is damp, and collects frost and ice in the winter. <br />The catwalk would provide access for cleaning the second <br />story windows. <br />
