BOARD OF ADJUSTMENT
FINDINGS, CONCLUSIONS AND ORDER
VARIANCE NO. 35-88
Based upcn the written request for a variance from the City's
zoning code by:
Marshall Batchelor
2714 Saratoga Lane
Everett, WA 98203
hereinafter referred to as "Applicant," for a variance from E.M.C.,
19.42.040 (B), Front Yirds, which requires that decks and porches',
in the front yard are allowed but only if they are less thane
forty-two inches high and have no roof covering to allow the)
existing front porch to be covered and a deck constructed that,
will be eight feet high and extend into the front yard areal
approximately four feet.
on the property commonly known as 2714 Saratoga Lane
The Board of Adjustment, following a public hearing on said
application held on November 7, 1988, and further having reviewed
all testimony, makes the following Findings, Conclusions and
Order:
That there have been exceptional or extraordinary)
circumstances or conditions applying to the subject
property or as to the intended use thereof that do not
apply generally to other properties in the same vicinity
or zone.
a. Finding: The subject property consists of an existing
single family structure on a 12,275 square foot lot. The
existing house does not meet front yard setback since it
is only 42 feet from the center line of Saratoga Lane
instead of the 55 feet required by code; however, it is
25 feet from the front property line which is the normal
front yard setback in the R-S zone.
The existing home is a single story structure with an
uncovered porch on the front. The Applicant is proposing
to construct a second story on the home and as part of
that construction to place a roof covering on the porch
and also construct a catwalk on the second level that
would extend an additional four feet into the front
setback area.
The Applicant wishes to cover the porch in order to
provide an aesthetically pleasing design, provide a safer
entry as the entry way currently is exposed, faces north,
is damp, and collects frost and ice in the winter.
The catwalk would provide access for cleaning the second
story windows.
