b. conclusion; There are unusual circumstances applying to <br />this property because of the existing house on the <br />property and the need to provide access to the second <br />floor windows and a covered entry for safety and <br />aesthetics. <br />criterion No__ZL <br />That such variance is necessary for the preservation and en- <br />joyment of a substantial property right of the appellant pos <br />sessed by the owners of other properties in the same vicinity or <br />zone. <br />a. Finding: most of the other five homes along Saratoga <br />Lane currently have less of a front yard setback than the <br />subject property's 25 feet, varying from eleven feet to <br />twenty-`wo feet and nine inches (see ;'xhibit 4). <br />b. Conclusion: Granting this variance would allow the owner <br />a property right enjoyed by others in the vicinity and <br />zone since even with the catwalk and covered porch in the <br />front yard area, the front setback would still be in <br />conformance with the other homes on Saratoga Lane. <br />grI;grion No. 3• <br />That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />a. Finding: The roof covering and catwalk would extend no <br />further towards the street than most other homes on <br />Saratoga Lane. There does not appear that there would be <br />any view blockage since there is already a row of fir <br />trees along the east property line and the catwalk would <br />be well below the level of the neighbor's deck to the <br />east. The improvements to the home should add to the <br />value of the home and enhance the property values in the <br />neighborhood. <br />b. Conclusion_ Granting this variance would not be <br />detrimental to the public welfare or injurious to other <br />property in the vicinity and zone. <br />(That the granting of such variance will not adversely affect the <br />I'comprehensi.ve General Plan. <br />a. Finding: The Everett General Plan designation for this <br />area is single family residential and the use is single <br />family residential. <br />b. Conclusion:_ Granting this variance will not adversely <br />!' affect the Everett General Plan. <br />i <br />NOW, 'r}iEREFORE, the Board of Adjustment of the City of Everett <br />does hereby order that the variance be GRANTED to allow instead of <br />and further require the applicant to meet the following <br />conditions. <br />1. The catwalk and porch covering shall be constructed per the <br />drawinus submitted with the variance application. <br />2. The Applicant shall obtain all necessary building permits. <br />
