The Applicant submitted that the dedication of a five <br />f�ot rig�t-of-way on Scenic Drive to the City of Ever�tt <br />for street purposes was agreeable to the Applicant. <br />27. The Applicant agreed to adhere to the requirements of <br />storm drainage as set forth in Condition #3. <br />28. The Applicant submitted that the full standard street <br />improvements were not needed at the subject property at <br />the present time. According to the Applicant the <br />development of the subject property will include a three <br />phased remodeling and construction project. Because <br />significant construction is not planned until the <br />Applicant switches from a 115 kV to a 230 kV system, it <br />is the position of the Applicant that no street <br />improvements should be required until that time which is <br />anticipated for at �east ten years. As an option, the <br />Applicant submitted hat they would sign an LID Covenant. <br />29. The Applicant submitted to be in agreement with the <br />recommended condition of approval #5. <br />30. The Applicant was in agreement with recommended <br />conditions �6 and A7. A condition to the agreement to <br />Condition �6 was that if street improvements ace <br />required on Scenic Drive, the Applicant would agree to a <br />perfotmance auarantee. <br />31. The Applicant'submitted to b� in agreement to Condition <br />#8 if a private retention, detention or other drainage <br />treatment facility were required. <br />32. The Applicant agreed to submit as-builts of the storm <br />sewer according to ti,� City design and construction <br />standards and specificati�ns. <br />33. The City of Everett submitted that it is their desire co <br />know where all fill matet:ials are being removed. The <br />purpose of this is to have contr.ol over the prevention <br />of the dumping of a*.y materials in any drainage <br />corridor. The Appli�ant agreed thaY. a permit for <br />destination of any fill materials removed from the site <br />would be requested, <br />34. The Applicant submitted that all static problems for <br />adjacent rEsidential owners will be resolved with the <br />proposed remodeling and development. <br />
