Engineer's cost estimate for construction of the wall designed by Dames and Moore; 2. Check in the amount of $199,063, equal to the engineer's cost estimate; and 3. Check in the amount of $7,500. Delivery of these documents to you represents full payment and final fulfillment of our obligations to you in accordance with the Agreement dated September 5, 1991. Also enclosed for your information are copies of the bid package prepared by Dames & Moore and the three bids actually received by Dames & Moore. As you are aware, and as stated in the settlement agreement, Boeing does not admit, and in fact expressly denies, liability in connection with damages to your property and house at 4937 Seabreeze Way in Everett. We have again carefully reviewed your claim and the various geotechnical analyses that have been performed on the property from 1966 to the present. The reports containing these analyses were prepared by professional engineers well qualified to examine and analyze %.he conditions of the property and provide conclusions regarding the causes of the earth sliding and erosion experienced on your property. The reports present no evidence that damage to your property has resulted from, or has been contributed to by, any development or use of Boeing's property in Everett. In fact, these reports provide strong evidence that factors unrelated to Boeing and Boeing's development are the causes of your property damage. This letter provides a brief history of the property and a summary of each of the geotechnical reports. These reports demonstrate that Boeing has no liability for the damage to your property.
