. 1 <br /> 6. The steep slope area must be identified as an Environmentaliy Sensitive Area. A <br /> covenant which identifies this area as such and which restricts future alteration or <br /> modification must be recorded for the property. <br /> 7. The applicant must record a covenant that runs with lhe land which waives claims <br /> against the City, its officers, empioyees and agents, and indemnifies (including <br /> reasonable attorney's fees), defends and saves the Cily, its officers, employees <br /> and ayents harmless from any loss or damage to people or property either on or <br /> off the subject property resulting from any form of soil movement whatsoever <br /> and/or from any form of failure in design and/or construction of the improvements <br /> thereon whatsoever. The owners of the subject property shall provide the City <br /> with the covenant and it shall be signed and acknowledged by all parties with an <br /> interest in the property. The covenanl shall also provide notice concerning the <br /> presence of uncontrolled fill and environmentally sensitive features on the <br /> property. The covenant must be presented to the City for review and approval <br /> and, upon approval, recorded by the appiicant with the Snohomish County Auditor <br /> prior to issuance o(any permits for the si�e. <br /> 8. Compliance with all other local, state and federal codes is required. <br /> APPEALS: This delermination may be appealed to the Land Use Hearing Exarniner. <br /> Any such appeal must be filed within 14 days of the date specified below. Appeal forms <br /> are available from the Planning Department and must be submitted along with the <br /> required filing fee.
