c �. <br /> The PlanninQ Oirector approved Me modificafions based on the followinp: <br /> Section 37.050.B of the zoning code allows the redudion of buiiding setbacks or butfers <br /> through Review Process 1. The Planninp Director, using Review Process I, ia authorized <br /> to "...approve, disapprove or approve with conditions the use proposed by the applicanC' <br /> (Subsection 42.100.B). <br /> The propeRy is zoned R-2, Single Family Detached Residential. A sinple family <br /> residence approximetely 1,892 square feet with 858 square feet attached garEge is <br /> proposed to be constructed on an approximately 125' X 430' lot on Seahurst Ave. The <br /> entlre lot is regulated as environmentally sensiGve area or required buffer. <br /> Section 37.050.8 states that nothing in the ESA ordinance is intended to preclude <br /> reasonable economic use of property as set foRh herein. If the requirement af this <br /> ordinance as applied to a specific lot would deny all reasonable e�nomic use of the lot, <br /> development will be permitted if the applicant demonsVates all of the following to the <br /> satisfaction of the Planning Director. <br /> 1. There is no other reasonabte use or feasible aftemative to the proposed <br /> development with less impact on the environmentally sensitive area; and <br /> 2. The proposed development does not pose a threat to the public health, safety <br /> and welfare on or off of the subject lot and <br /> 3. Any alterations pertnitted to the requirements of this Ordinance shall be the <br /> minimum necessary to ailow for reasunable use of the property; and <br /> 4. The inability of the applicant to derive reasonable economic use of the propeRy is <br /> not the result of actions by the applicant in subdividing the property or adjusting a <br /> boundary line thereby creating the undevelopable condition after the effective <br /> date of this Ordinance; and <br /> 5. The proposal mitigates the impads on the environmentally sensitive areas to the <br /> maximum extent possible. <br /> The Planning Directors conclusions are as follows: <br /> 1. There is no olher reasonable use or alfemative to the proposed deve/opmenf wKh <br /> less impact upon the envi�anmentaNy sensiNve area. The R-2 zone allows a <br /> single family residence on a minimum lot size of 4,500 square feet The property <br /> is approximately 1.23 acres fn size. To build only one single family residence <br /> upon the property is the least intensive"reasonable"tand use for this property. <br /> 2. The p►oposed development does not pose a threat to fha public health, safety and <br /> weHe�e on or oN of the subject lot. No adverse impacts to public safety ere <br /> antidpated off the subject property as a resuR of the proposal. It has been <br /> recommended to the applicant that a soils/sWcturel engineer be co�suRed <br /> regarcJing consuuc4on methods for the site deveiopment. <br /> �3 <br />
