Bilistin of 3505 Upland Avenue was against the issuance of a <br /> variance because of the increased problem of drainage. If the <br /> drainage could be controlled he would have no other objection. <br /> After visually viewing the subject property and considering all <br /> the facts, it was moved by h1r. Cornin, seconded by Mr. IIaird, <br /> and iinanimously carried to grant the applicant' s request for <br /> the follocainc� reasons: <br /> 7_. There are exceptional circumstances applying to the <br /> subject property that do not apply to other properties <br /> in the same vicinity specificaliy that this is an <br /> irregularly shaped parcel with no particular access on <br /> the east side anc'. further that although the frontage wil.l be <br /> below the minim�vn, total square footage of the lots will <br /> exceed the minimum code requirement. <br /> 2. That the variance is necessary for the preservation and <br /> enjo,�ment of a substantial property right specifically <br /> that there is too mucn land for only one structure. <br /> 3. Granting the var.iance will not be detrimental to the <br /> public welfare or injurious to property in the vicinity <br /> because all city codes will be met, th�re will be no <br /> view oUstructions, and lot sizes will exceed code minimums. <br /> � 4 . Tlie granting of the variance will not adversely aff:ecC <br /> the comprehensive plan because the resulti.ng density will <br /> be less than otherwise allowed on parcels of similar size. <br /> As a condition to the granting of this variancc, the following <br /> stipulations were made: <br /> 1.
