t <br /> SURFACE WATER DRAINAGE AGREEMENT <br /> THIS AGREEMENT, made and entered into this _ day of , <br /> 1980, by and between JOHN FLUKE MFG. C0. , INC. , a Washington <br /> corporation, hereinafter referred to as "Fluke, " and THE BOEING <br /> COMPANY, a Delaware corporation, hereinafter referred to as <br /> "Boeing, " <br /> W I T N E S S E T H: <br /> WfiEREAS, Fluke is the sole current holder of fee title to <br /> all that certain real property ("Tract A" ) more particularly de- <br /> scribed in Exhibit A attached hereto and made a part hereof; and <br /> WHEREAS, Boeing is the sole current holder of fee title to <br /> al.l that certain real property ("Tract B" ) more particularly <br /> described in Exhibit B attached hereto and made a part hereof; <br /> and <br /> ' WHEREAS, the parties hereto desire to establish a manner in <br /> which to collect, channel and discharge the surface waters col- <br /> lecting upon Tract A and Tract B to the extent herein provided <br /> for; <br /> NOW, THEREFORE, in consideration of the premises and the <br /> mutual covenant= and conditions herein contained, the parties <br /> hereto, for themselves and their respective successors and assigns, <br /> do hereby declare, state, establish and confirm that Tract A and <br /> Tract B shall be continuously subject to the following easements, <br /> covenants, conditions and restrictions harein contained: <br /> 1. As indicated in Exhibit C hereto, certain portions of <br /> Tract A shall be employed for three conduit:; (the "Conduits" ) and <br /> the Conduits shall be employed solely for the drainage of natur- <br /> ally accumulating surface water on said Tra.ct A and Tract B and <br /> the improvements now and hereafter constructed thereon into a <br />
