Fluke shall cause the Conduits to be constructed, maintained and repaired, and the same shall consist of 30" 14- gauqe aluminum, the sole purpose of which shall be to channel naturally accumulating surface water into the Reservoir. Fluke shall also provide for the Reservoir overflow to be directed into existing and future public storm drains so as to enable the i Reservoir to be maintained at a reasonably constant level. l 3. The parties hereto specifically agree that clean sur- face water only may be channeled into the Conduits or the Reser- voir, and that the maximum contributed amounts to the Conduits �� and the Reservoir shall be thirty-nine (39) cubic feet per second from Tract A and one-hundred twenty-two and 3/10 (122.3) cubic�p"`�� feet per second from Tract B. ' The parties shall take all reason- ' able steps necessary to prevent foreign substances from entering the Conduits and the Reservoir, and specifically, no chemicals, oil, silt or other pollution or debris shall be permitted therein. In furtherance of the foregoing, Boeing shall be solely respon- sible for channeling the surface runoff on Tract B to a collec- tion point at the intersection of the Conduits with the parties' respective property lines, and Boeing shall construct and con- tinuously maintain a facility on Tract B in the immediate vicinity of such intersection for oil filtering and draining, and, in the event any portion of Tract B should be developed or improved by Boeing, its successors or assigns, the ownex• or owners of Zract B shall take all other reasonable precautions to ensure that the water discharged from construction sites shall be free of foreign substances, including silt, chemicals and oil. -2-
