• �` <br /> All oi the exhibits are avaiiable for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore A�enue, 8th floor, Everett, Washington. <br /> After due consideration of the testimony and evidence presented by the Applicant and <br /> testimony and evidence elicited during the public hearing, tlie following Findings of Fact <br /> and Conclusions constitute the basis of the decision of the Everett Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval of an exception to the provisions of Everett <br /> Municipal Code (EMC) 19.7.020.H which limit the height of detached accessory <br /> slructures to a maximum of 15 feet. The Applicant intends to develop a detached <br /> garage on lhe property at 614 Warren Avenue, Everett, Washington, and seeks <br /> an exception as allowed pursuant to EMC 19.7.020.K. (exhibit 1, Fauver <br /> testimony) <br /> 2. The subject property is zoned R-1, Single-Family Medium Density. It is <br /> developed with a single-family residence. It is the intent of the Applicanl to <br /> construct a detached garac�e on-site with a height of 20 feet. (exhibits 1 & 4) <br /> 3. EMC 19.7.020.K establishes crileria a,�d guidelines for ih2 Hearing Examiner to <br /> consider in determining if an exception to the 15-foot height standard of EMC <br /> 19.7.020.H should be granted. In reviewing ihe criteria and guidelines, the <br /> Hearing Examiner must consider factors such as view obstruction, aesthetic <br /> impacl on surrounding properties and streetscape, incompatible scale with <br /> dwellings on surrounding properties, and the impact to ihe neighborhood <br /> character. (exhibit 1) <br /> 4. The proposed 20-foot high detaclied garage would be located off an alley on the <br /> southern portion of lhe subject property. The slope of the subject property is to <br /> lhe north away from the alley. It is the intent of lhe Applicant to enter ihe garage <br /> at grade from the alley. In order to accammodate a roof pitch similar to the <br /> residence on-site, as well a� allow for storage over the garage, a height <br /> modification is necessary. The requested detached garage and roof pitch would <br /> be consistent with the residence on-s .e and those on the suRounding properties. <br /> (Fauver testimony) <br /> 5. The subject property fronts Warren Avenue which sits lower lhan houses located <br /> south of the site fronting 33rd Street. This creates the impression that the <br /> struciures are not as high as ihey actually are. In addition, mature veaetation is <br /> present. (exhibit 1) <br /> 6. The proposed slruclure would not be significantly visible from the street because <br /> il wouid be located behind an existing residence.
