� 1 <br /> 7. Currently on Warren Avenue there are no defined parking areas. Much of the <br /> parking occurs on the street. The Applicant desires to park off the aliey at his <br /> properly, but there in insufficient room. With the development of the garage, the <br /> Applicant would be able to utilize alley parking and d�crease impacts on Warren <br /> Avenue. This would be a benefit to the neighborhood. (exhibit 1) <br /> 8. In an R-1 zone, the maximum height for singie-family residences is 28 feet. At <br /> complete build-out, the proposed structure would be eight feet below the 28-foot <br /> height standard. As noted, it would allow for access off the alley. Further, with <br /> the topography changes in the area, it would not appear to be out of scale of <br /> other residences or garages within the neighborhood and general vicinity. <br /> (exhibit 1) <br /> Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision. That authority is set inrth in EMC 15.16.100. <br /> Based on the above Findings of Fact, the Hearing Examiner enters the follcwing <br /> Conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval of 2n exception to the provisions of Everett <br /> Municipal Code (EMC) 19.7.020.H which limit the height of detached accessory <br /> structures to a maximum of 15 feet. The Applicant intends to develop a detached <br /> garage on the property at 614 Warren Avenue, Everett, Washington, and seeks <br /> an exception as allowed pursuant to EPAC 19.7.020.K. (finding 1) <br /> 2. EMC 19.7.020.H establishes that detached accessory structures cannot exceed <br /> 15 feet in height unless an exception is approved pursuant to the guidelines as <br /> set forth in EMC 19.7.020.K. These exceptions are set forth in finding #3. <br /> 3. The Applicanl aiid the City have presented testimony and evidence with support <br /> the exception. The manner in which the guidelines oi �MC 19.7.020.K are <br /> satisfied are sel forth in findings 4 through 8. <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that Don Loen is granted <br /> an exception for the development of a detached accessory structure on the property <br /> located at 614 Warren Avenue, Everett, Washington. The specific exception is that the <br /> Appiicant is allowed to develop a 672 square foot detached garage to a height of 20 <br /> feet.
