Port Gardner Bay Outfall Replacement Agreement <br /> any costs for financial contribution to the Port's shoreline public access <br /> improvements, shall be credited against the City's obligations <br /> hereunder. <br /> 10.2.4.4 Each party shall obtain separately and pay for any property or rights-of- <br /> way for Other Facilities. <br /> 10.3 Permitting <br /> 10.3.1 K-C shall apply for governmental permits and approvals for construction and <br /> operation of the Joint Use Facilities. The City shall provide technical support <br /> and information required to complete applications and submittals; provided, <br /> however,the City's support shall not be construed to limit the City's exercise of <br /> its legislative, police and regulatory powers. The PRT shall review draft permit <br /> applications and technical submittals for the Joint Use Facilities prior to filing <br /> with governmental agencies. K-C shall prepare and submit the required SEPA <br /> documents, and the City shall serve as the lead agency for the SEPA process <br /> required for the Joint Use Facilities and for any subsequent replacement or <br /> repairs undertaken pursuant to this Agreement. <br /> 10.3.2 Applications for permits and other required approvals shall be filed in sufficient <br /> time so that the Joint Use Facilities shall be operational when required by this <br /> Agreement. Sufficient time includes, but is not limited to, allowing for <br /> reasonable delays that may be encountered in the regulatory process. <br /> 15 of 46 <br />
