Port Gardner Bay Outfall Replacement Agreement <br /> 10.4 Design <br /> 10.4.1 K-C shall employ one or more qualified engineering firms to prepare a Final <br /> Design. <br /> 10.4.1.1 The Final Design will include, but not be limited to: (a) biddable and <br /> constructable drawings and specifications; (b) an updated Class 10 <br /> Estimate; (c) adequate subsurface investigation that will reasonably <br /> depict subsurface conditions that may be encountered by the <br /> Construction Contractor and(d) at least two sets of as-built drawings <br /> upon completion of the Project. <br /> 10.4.1.2 K-C shall submit the Class 10 Estimate to the PRT for review and <br /> approval which approval shall be a condition for K-C to advertise for <br /> bids to select a Construction Contractor. <br /> 10.4.2 At its option, the PRT or one or more Participant's representative may <br /> interview engineering, design, construction management, and construction <br /> firms, and may advise K-C as to recommendations concerning the <br /> qualifications of such firms. <br /> 10.4.3 The PRT may inspect, review and comment on any design or construction <br /> documents and attend meetings with the firm preparing the Final Design. K- <br /> C shall be solely responsible for providing direction to the design firm and <br /> neither the City nor the PRT shall directly instruct the design firm. The <br /> City's review or attendance at meetings shall not create any privity between <br /> the design firm and the City, nor shall it relieve K-C of any of its <br /> responsibilities under this Agreement. <br /> 16 of 46 <br />
