2. The property is zoned 8-3, Central Business District zone. (finding 5) The <br /> requested variance seeks relief from EMC 19.22.020.F which prohibits <br /> freestanding signs or backlit signs on a sheet five square feet or greater in a B3, <br /> Central Business District zone; and EMC 19.22.020.F which establishes the <br /> maximum sign area as 40 square feet. (finding 4) <br /> 3. The variance will not be materially detrimental to the property in tf ie area of the <br /> subject prope�ty or the City as a whole. The long-term existence of the <br /> freestanding sign provides some direction of the use of the subject properry as a <br /> drive-thru bank. The drive-thru bank building is set back from the comer lot and <br /> without the freestanding sign that use could be difficult to ascertain from the <br /> street. (findings 4 8 9) <br /> 4. The variance is necessary because of the location of a pre-existing improvement <br /> on the subject property that conformed to the zoning code in effect when the <br /> improvement was constructed. The freestanding sign has been on site for yea�s. <br /> (Fndings 6 & 7) <br /> 5. The variance will grant the subject property the same general rights enjoyed by <br /> other properties in :he same area and zone as the subject property. Because <br /> every variance is based on its own unique facts, there are factors that must be <br /> considered with the instant application. These facts include: the freestanding <br /> sign has been on-site for years; the vegetation on the streets that front the <br /> subject property will create some view blockage for the proposed wall signs on <br /> the building on-site; the building on-site is set back from the street creating <br /> significant setbacks that are not common with other properties. These factors all <br /> contribute to a condition for a variance in order to allow similar property rights as <br /> are in the same area and zone. (frndings 9, 10 & 11) <br /> 6. The variance is the minimum necessary to allow the subject property the general <br /> rights described in Criteria 3 above. (Fnding 29) <br /> 7. The grant of the variance is not inconsistent with the goals and policies of the <br /> Everett General Comprehensive Plan. It is consistent with the Comprehensive <br /> Plan designation of the site. ((inding 15) <br /> S. The need for the requested variance is not the result of a self-created hardship. <br /> (findings 9, 10 & 11 J <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that the requested <br /> variance from the Ciry of Everett sign code standards is granted. The granted variance <br /> allows an existing freestanding sign to remain in place while lwo new wall signs can be <br /> attached to the building on property at 2606 Wetmore Avenue, Everett, Washington. <br /> 7 <br />
