The variance allows for the nonconf�rming freestanding sign to remain and the <br /> maximum sign area of 40 square feet to be exceeded. The variance is granted subject <br /> to the following conditions: <br /> 1. Ths Applicant must secure ali necessary building permits from the City of <br /> Everett. <br /> 2. The proposed two new wall signs cannot exceed in square footage the design as <br /> submitted to the City for review of the requested variance. <br /> Gommenta <br /> In the State of Washington each variance is granted on its own unique individual facts. <br /> For the instant case, the unique facts include the location of the building being seffiack <br /> from two streets; the long-tertn use of the existing freestanding sign and the mature <br /> vegetation, i�cluding trees, along both 26th Street and Wetmore Avenue that create <br /> some problems in viewing the freestanding sign. The grant of this variance should not <br /> be interpreted as suppoR fo�any other variance for signs within the City of Everett. In <br /> order for a sign variance to be granted within the City, the applicant must prove that all <br /> of the criteria of EMC 19.41.1:�O.0 are satisfied. The applicant in each case must prove <br /> that the unique facts justify a detertnination that all criteria and standards are mEt.
