.�, <br />>�4. <br />gpARp OF ADJi1STl�NT <br />FINDZNGS, CONCLUSIONS AND ORDffi2 VARIANCE NO. 32-88 <br />Based upon tt,e written request for a variance from the Cit��'s <br />zoning code by: <br />Snohomish County-Ca.mano Board of R�altors <br />3201 Wetmore <br />Everett, WA 98201 <br />'hereinafter referred to as "Applicant," for a variance from <br />,E.M.C. 19.40.020, Parking to allow an exempti�n from the 19 <br />loff-street parking spaces required by code for a change of use of <br />;two residential structures, one at 1701 32nd St. to be used for <br />ioffice space and two dwelliing units and one at 3201 Wetmore to be <br />used as office space. <br />on the following descri)�ed property: <br />Lots 1 and 2, Block 766, Plat of Everett <br />IThe Board of Adjustment, following a public hesring on said <br />iagplication held on October lo, 1988, and further having reviewed <br />;all testimony, makes the following Findings, Conclusions and <br />;order: <br />IFINDZNGS �wD COIiCLUSIONS: <br />�itorion No. 1• <br />;�That there have been exceptional or extraordinary circumstances <br />�or conditions applying to the subject property or as to the in- <br />�tended use thereof that �:o not apply generally to other <br />�properties in the same vicinity or zone. <br />a. Findina: The property consists of two buildings on a I <br />6,000 square foot lot both owned by the �nohomish <br />County-Camano Boird of Realtors. Both buildi�:qs were con-i <br />structed as single family residences in the ea:ly 1900's. <br />�710 32nd Street: This structure was constructed as ai <br />single family residence and there are no buildinq permits <br />in file to indicate when the number of dwellinq units wasl <br />increased. Senator Vognild began usinq the qarage as of-; <br />fice space when he was a resident in the building in thel <br />early 1980's and has continued to use the space for his� <br />office since he moved out of ttte residential unit. � <br />3201 Wetmore: This structure was constructed as a�inqlel <br />family residence and usEd as such until purchased byi <br />Snohomish County-Camano Aoard of Realtors in November of� <br />1986, after which they be�an to use it as an office.� <br />Snohomish County-Camano Board of Realtors applied for a� <br />business license in February 1987 and at that time they <br />were informed that they would need to obtain a Use Permiti <br />since the use was permitted in the zone but the building, <br />was constructed as a single family residence. <br />A Use Permit is required by the Czty when a proposed usei <br />is a permitted use in the zone but the building was con-, <br />structed for residential purposes. The reason for this <br />requirement is that the residential uses have a much lower. <br />parking requirement than a commercial use and because a; <br />residential structure may noL• meet Uniform Buildinq Code <br />(UBC) requirements for commercial structures. The appli- <br />cant for a Use Permit must provide parking to code for the, <br />use proposed and also obtain ai Building Permit in order to. <br />show that the construction m�aets the UBC requirement for, <br />the particular use. The City was in correspondence with <br />Snohomish County-Camano IIoard of Realt.ors from February <br />1987 to August 8, 1988 in an attempt t:o obtain a complete <br />Use Permit Application. <br />
