Rather the circumstances are special because of the <br />fact that here are 80 foot right-of-ways on 32nd• and on Wetmore <br />and that the applica ion of the set back requirements deprives the <br />fee owner of the reasonable use of the property. Further, <br />practically, economicalxy and esthethically the new building is <br />better placed closer to the lot lines, in the same location as the <br />existing building. <br />The existing and new buildings along_ Wetmore between Pacific and <br />3th. have su u�an` �.ype front yards because o£ t e 80 foot <br />riq t-of-way. T e oat Z3zTti -o -way in and of itself, even <br />withou— t tTie addition of the 10 foot set back requirement would <br />provide for generous distances between the street and the building <br />fronts. The esthetics sought by the City with the 10 foot <br />setbacks is achieved by their noM use of a major portion of the 80 <br />foot right-of-way. Why should the city place the burden on the <br />property owner for maintainances of the distances from the actual <br />street, as it is currently used, rather than bearing it themselves <br />with the unused right -of way? <br />If the existing building on the subject property were to remain or <br />be remodeled, it would stay where it is, with no space between it <br />and the property line. Once torn down, to make way for the <br />construction of a building which would_- provide a definate visual <br />improvement at a prominate intersection, we are deprived of the <br />use of 10 feet on each si3e. ---- <br />In conclusion, the application of the 10 foot set back requirement <br />is not needed to accomplish the purpose of ample front yards with <br />nice landscaping. Added to the 80 foot right-of-way, the City <br />then has 100 feet , while the property owners' lot size is <br />reduced, on a corner, by 10 usuable feet in two directions. An <br />owner of a corner lot where there is an 80 foot right- of -way has <br />a greater burden to bear on than does an owner in the middle of <br />the block. <br />
