certified mail to Steven R. Bartlow, Barbara J. Bartlow, Esther M. Brandsma and <br />C.A. Brandsma; <br />8. That on June 25, 1998 I received the receipts for said certified delivery; <br />9. That the Notice and Order for each building requires that the building shall either be <br />demolished or repaired in accordance witn all current building codes and all other <br />applicable City of Everett codes; <br />10. That the Node:^ and Order for each building gives required dates for securing permits, <br />physically co,nmen,.ing work and completing work; <br />11. That the Notice and Order for each building provides that any person having any <br />record tith, or legal interest in the building may appeal from the Notice and Order <br />within this iy (30) days of service of the Notice and Order; <br />12. Tha.. on July 16, 1998 Steven R. and Barbara J. Bartlow sent a letter to the Building <br />Official stating that the building at 3229B Wetmore Avenue was secure again, that <br />they had made application for a building permit, that their plans are to demolish both <br />buildings as soon as the permit is obtained and financing is available, and that <br />building department staff had told them the permit could be ready by approximately <br />August 1, 1998; <br />13. That it is my belief that the July 16, 1998 letter is a request for an extension of time <br />and not an appeal of the Notice and Orders that were issued on June 19, 1998; <br />14. That on September 11, 1998 I sent a letter to Steven R. and Barbara J. Bartlow, via <br />certified and regular mail, giving them final notice of the following: (a) That the <br />buildings are substandard and dangerous; (b) that the Bartlows had not obtained a <br />permit by August 1, 1998 as they stated they would do in the July 16"' letter; and (c) <br />that the matters were scheduled for the September 23, 1998 City Council hearing for a <br />resolution to demolish both buildings; <br />15. That I did not receive any response to the September 11 ih letter; <br />16. That I was at the September 23, 1998 City Council hearing and there was no one <br />present identifying himself or herself as Steven R. Bartlow or Barbara J. Bartlow; <br />17. That on September 23, 1998 the Everett City Council adopted a resolution pursuant to <br />the Uniform Housing Code and the Uniform Code for the Abatement of Dangerous <br />Buildings authorizing the demolition and clearing of the buildings located at 3229A <br />and 3229B Wetmore Avenue; <br />18. That on September 23, 1998 I sent letters to Steven R. and Barbara J. Bartlow and <br />C.A. and Esther Brandsma advising them that the resolution was adopted; <br />19. That on September 25, 1998 the Building Official notified my director, Laura Van <br />Slyck, that he had spoken with Steven Bartlow and that Mr. Bartlow had mentioned <br />an "appc3l" and that he was requesting more time to demolish the buildings; <br />20. That on October 6, 1998 Laura Van Slyck sent Steven R. and Barbara J. Bartlow a <br />letter, via certified and regular mail, notiiying them that because of Steven Bartlow's <br />conversation with the Building Official an appeal hearing was being scheduled and <br />AFFIDAVIT OF MARIAN G.
