::enneth Mayer Appeal <br />Appeal 7-90 <br />Page -3- <br />CONCLUSIONS <br />1. The Appellant requested a Use Peimit for proper[y at 3330 Wetmore <br />Avenue, Everett, W�shington. The Use Permit was requested on June 7, <br />1990. The Citq of Everett refuaed to process the requeat because the <br />proposed office wae not a permitted use ia the R-4 zone in which the <br />property La located. �n appeal of this refueal aae filed by the <br />Appellant. <br />2. The request of the Appellant is governed by the provisions of the <br />Everett Zoning Code effective January 13, 1990. <br />3. The propoaed office use is not a permitted uae ia an R-4 cone in the <br />City of Everett. <br />4. The Appellant xas not vested for the development of aa office use <br />pursuant to [he provisions of the Everett Zoning Code, Section 44.5 et <br />seq. <br />5. The propoaed project must be developed pursuant to the zoning <br />regulatione of the January 13, 1990, Everett Zoniag Code. The Appellant <br />ia not allowed to have hia application reviexed and the proposed project <br />developed under the zoning regulation procedures that existed prior to <br />January 13, 1990. The Appellant doea not have a veeted right for the <br />proposed office uae in ehe R-4 zone. <br />6. There wae no completed Huilding Permit Application nor other laad use <br />approval to xarrant veating of the Appellant. <br />7. Adequate public notice was given of the zoning change and the adaption <br />of the new Zoning Code. The public, including the Appellant, xere put <br />on notice of the zoning change and the a1loWed usea in the R-4 zone. <br />8. The City of Everett Utility Servicea Department's actions do not <br />constitute a vesting of developmental righta for the Appellant. The <br />City of Everett Planning Department and the land use review proceas muet <br />be adhered to in order for vesting to occur. <br />DECISION <br />Based upon the preceding findings of facts and conclusions of law, the <br />testimony and evidence suYmitted at the public hearing, and upon the <br />impresaiona of the Everett Hearing Esaminer, the City of Everett <br />administrative decision refusing to process a Uae Pecmit Application for <br />converaion of a aingle-family reaidence to an office uae at 3330 Wetmore <br />Avenue, Everett, Washington, is upheld. <br />
