That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of <br />other properties in the same vicinity or zone. <br />Finding: There are various fast food restaurants that do not meet <br />zoning code requirements. <br />Conclusion: This variance will be consistent with similar uses. <br />3. That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />Finding: The parking study shows that Arby's does not use its amount <br />of parking and that there is an excess. The Zoning Code comparison <br />shows Everett Requirements is one of the most restrictive. <br />Conclusion: The proposed number of spaces shown will be adequate for <br />Arby's. <br />4. That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />Finding: The Comprehensive Plan shows this area as Commercial. <br />Conclusion: This use is consistent with the Conprehensive Plan <br />designation. This variance will not affect the Comprehensive Plan. <br />RECOMMENDATION: APPROVE <br />APPROVE the variance as requested by applicant with the following conditions. <br />Staff Analysis: The past thirty years has produced a significant change in <br />the operation of fast food restaurants. The drive-in car hop restaurant in <br />the 1950's has given way to the stop-in/take out or sit down establishment. <br />They are serving a more family oriented atmosphere and larger numbers of <br />people having a higher turnover. Our current code was written and regulated <br />for the 1950's type of fast food restaurant. The ASPO survey showed that <br />parking needs should be determined site by site by the following: 1) <br />anticipated volume of store, 2) type of location, 3) amount of pedestrian <br />traffic, 4) number of seats, 5) local ordinance.
