That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of <br />other properties in the same vicinity or zone. <br />Finding: Both uses proposed in this project are allowed in the B-2 <br />zone. However, both uses are not likely to be in operation at the same <br />time. Peak times when the retail needs available parking should not <br />conflict with office uses. <br />Conclusion: Mixed use projects should be allowed to share common <br />parking areas with conditions. <br />3• That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />Finding: Village Square Shopping Center is owned by the applicant. <br />There is no on -street parking in this area. <br />Conclusion: If there is no available parking people will not use this <br />center. <br />4. That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />Finding: The Comprehensive Plan shows this area as Commercial. <br />Conclusion: This project will have no adverse effect on the <br />Comprehensive Plan. <br />RECOMMENDATION: APPROVE <br />APPROVE the variance as requested by applicant with the following conditions. <br />1. The east parking lot shall be signed for office parking during the <br />week. It will be used as overflow parking for retail activities on <br />weekends and when offices are closed. <br />2.
