NUN-CONFORMING BUILD[NG AND <br />CERTIFICATION OF LOT STATUS #8-96 <br />PL.ANNiNG DIRECTOR DETERMINATION <br />Applicant: Bruce & Halley Gagnon, 401 Alverson Blvd., Everett, WA 98201 <br />Descriation of proaertv structure(sl and/or aarcel(sl beine certified: <br />Zoning: R-1, Single Family Residential <br />Legal Description: Lot 1-2, Block 105, Plat of Everett Division "S" <br />Site Addres�: 401 Alverson Boulevard <br />The subject parcel (tax account #4368-105-001-0002), is a 6,000 square foot lot which <br />is 50 feet wide by 120 feet deep. It is developed with a 1,924 square foot single family <br />residence and 525 square foot attached garage measurtng 21' X 25'. The residence <br />consists of a 1,040 square foot first floor, a 260 square foot second 800r and 624 squaze <br />foot unfinished basement. The residence meets all minimum setback requirements with <br />the exception of the laundry room and attached garage structure. <br />The garage and laundry room do not meet the required 10 foot strcet side setback from <br />4th Street and actually encroach into the 4th Street right-of-way. Also, the attached <br />garage is located only 1 foot 8 inches &om the rear (east) property line abutting the <br />alley. These setbacks aze hereby recognizsd and wnsidered legal non-confortning <br />because the house was const�ucted in 1940 and the garage in 1950 according to the <br />Snohomish County Assessor's records which pre-dates the City's wning code <br />estabGshing min'unum setback requirements. <br />NOTE:. All portions of the residence and gerage shucture that encroach ic►to the pubfic <br />right-of-way must be removed. The applicant plans a remodel of the residence and <br />garage and wil! remove these encroachments at that time. <br />The above stnrcture(s) and/or parcel(s) meets the City of Everett Zoning Code and/or <br />Subdivision Ordinance in effect at the time of construction or that the comeyance <br />transactions which created the above parcel(s) were recorded in the County Auditor's <br />Office. I hereby find that the above structure(s) and/or pazcel(s) are legal non- <br />conforming under the City of Everett Zoning Code and/or Subdivision Ordinance.
