� <br />Criterion No 2• <br />� <br />That such variance is necessary for the preservation and enjoy- <br />ment of a substantial property right of the appellant possessed <br />by the owners of other properties in the same vicir.ity or 2one. <br />�. Findina: other property owners in the vicinity and zone <br />have attached garages or carports, and because of. the existinq <br />conditions on this property, the location of ar attached carport <br />is limited to the north side of the house over the existing <br />driveway. <br />b. �onclu��on• Granting a variance to allow a zero foot side <br />setback would allow the applicant a property right possessed by <br />others in this vicinity and zone. <br />Criterion No. 3: <br />That the authorization of such v:riance will not be materially <br />detrimental to the public welfare or injurious to property in <br />the vicinity or zone in which the property is located. <br />a. Findina: The northern driveway access off Wetmore is shared <br />by the Applicant and the property to the north through easeme�t. <br />The house to the norih is located approximately 15 feet frcm the <br />property line and so there would still be ample separation be- <br />tween the proposed carport and the house te the north. in addi- <br />tion, no adverse comments have been received in response to no- <br />tice sent to property owners within 300 feet. <br />b. Conclusion• it does not appear thst granting the variance <br />to allow a zero foot side yard set back would be detrimental to <br />the public welfare or injurioo.s to others in the vicinity and <br />zone. <br />That the qranting of such variance will not adversely affect the <br />Comprehensive Genzrtl Plan. <br />a• ElIldlig;. The General Plan designation for this area is <br />single family detached, 5 to 10 dwelling units per acre, and <br />carports are accessory uses to single family. <br />b• ��141.1s�� Grani:ng this variance will not adversely af- <br />fect the General Plan. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett <br />does hereby order that the variance be GRANTED to allow con- <br />struction of a carport that would be parallel to the house with <br />the northeast corner of the carport having a zero foot setback <br />instead of the six feet required by code. <br />The action of the Board of Adjustment in GRANTING a varian�e <br />shall be final and conclusive, unless within fifteen (15) days <br />from the date of issuance and signing of this order by the <br />Chairman of the Board, an aggrieved person or persons obtains a <br />writ of certiorari from the Superior Court of Washington for <br />Snohomish County for the purpose of review of the acrion taken. <br />DATED this }h%' day of -'L�TCt3E/�' 1989. <br />, <br />,r .K�k�'� <br />Ch irman, Board of Adjustment <br />
