the membership of the Committee may be change� or the powers <br />and duties of the Committee enlarged o� ceatricted by vote of a <br />majocity of the membere of the Home Owners' Associati�n who are <br />vot:ing in per�on or by proxy at a meeting called for that <br />pui•pase. , <br />8,2 Jurisdiction and Puroose: The Committee shall <br />ha�e the right to review and thereby either approve or reject <br />all plans and specificationa for any building or stcucture to <br />be conatructed or modified within the properties which do not <br />confocm to the architectural guidelines. Enforcement of these <br />covenanta ahall be carried out by the Larimer Ridge Home <br />Owner's Aaeociation. <br />8.2.1 No building ahall be ec�cted, placed or <br />altered on any lot until the building plan, epecificatione, <br />plot plan and landecape plans are submitted by the owner or hie <br />repreaentative to the Architectural Control Committee and found <br />by said Committee to be in accordance with the guidelines and <br />the procedures eatablished by the Committee. It shall be the <br />obligation of each owner to familiarize himself with the rules, <br />cequlatione and procedures of the Committee. All coete <br />incurred by the Committee for inspectiona, plan review and <br />conaultante shall be paid for by the applicant. <br />; . . . . � .iR�� <br />8,3.1 Any approval requeated of the Committee <br />shall be requeated in writing and shall be submitted to the <br />Asaociation headquarters unlesa the committee ehall record an <br />inatrument establiahing a different place to submit such plana. <br />8.3.2 In the evettt the Architectural Control <br />Committee failes to reapond to the 'owner's application and <br />eubmittal, with reference to proposed plans and epecificatione <br />within thirty (30) days after said plana and epecifications <br />have been aubmitted by the owner in writing to the Committee <br />for auch prupoeed construction, addition, alteration or change, <br />then and in that event, compliance will be deemed to have been <br />granted by said Committee and formal written approval will not <br />be cequired and thia provision shall be deemed to have been <br />fully complied with, in the event an owner entera into <br />conatruction, addition, altetation or change of any building on <br />a� building site on the properties without having firat <br />submitted,in writing the proposed plans and specifications to <br />the Committee for such work and completes such work without any <br />notice of non-compliance from the Association or said <br />Committee, then and in that event, after the lapse of six ,(6) <br />montr.s from the completion of such wock with no suit or action <br />having been brought to enjoin the conatruction, addition� <br />altoration or change or to force compliance by change or <br />removal of such work with this provision then approval will not <br />be required and this provision shall be deemed to have been <br />fully complied with. The deciaion of a majority of the membera <br />of the Committee'shall be the decision of the Committee. <br />';`8.3.3 The Committee, in the discharge of its <br />obligations heceunder and in its deliberations, shall act <br />objectively and fairly tn making decisions concerning various <br />plans, specifications, plot plans and landacape plans aubmitted <br />to it by varioue owners for con3ideration.
