Jessop Construction <br />2702 22nd. <br />Everett, Wa. 98201 <br />Dear Gary: <br />I sincerely hope and pray that this official notice to you in no way <br />affects our friendliness towards each other. Tt�ere does come a time when <br />facts should be put down in writing rather than the spoken word so I�11 <br />set the facts out below: <br />�1.) The Association will not authorize or permit the hooking up of any <br />sewer from the lot you are presently building on, Lot 9, to or through Lot 8': <br />sewer connection. That would make 3 building sites hooking onto the same <br />sewer within a 15' or 20' area and would no doubt cause sewage blockage as <br />the plat was not developed for 3 hook-ups there and not designed for it. <br />Lot 9 is to hook up to the sewer in the street and I sincerely }�ope you <br />can without having to pump it into it. <br />(2.) In regards to our conversation the other day on �1 aoove, we also <br />discussed your buying and building on Lot S. I want you to be ,aware that <br />there is an agreement between Mr. Spelhaug and Dr. Smith, the d�aveloper, <br />and now.the Larimer Ridge Home Owners Association that shows anct designates <br />where his home was to be built. It is, as I call it, down to tl�e east, in <br />the low spot. By doing this he could build it any height he wanted to. <br />To my knowledge, this agreement has never been recinded or changed. <br />If the building site remains down there, then the sewage would have <br />to be pumped up to the sewer connection line on that Lot 8. <br />If you were to build up higher, Eurther west, then you are subject to <br />the 14' height restriction and I am sure the owners of Lots 9••10-11 and <br />even 12 would not allow a varience here. <br />That is the very reason Mr. Spelhaug was going to build in such a spot <br />because he had to because if he moved it at all west, to speak of, he would <br />be under the 14' ru]e and you can see this set out in the hrticles of Inc. <br />One of the reasons your place on Lot 9 sold so f.ast is no doubt due to <br />the covenants and restrictions, etc., that this little spot of 21 owners <br />has and the knowledge that all the covenants and Architectural Committee <br />proceeds will be followed to the letter of the law. I beleive it was Lot 3 <br />down the street from us - had his roof line approximately 16'�- 17'�too <br />high and the roof was on and everything about done to the house and the build� <br />had to take off shingles and etc., and lower it down to 14'. Our neighbor <br />to the south� Mr. Greer� on Lot 6 put up a chain link fence all around his <br />front yard and he was Eorced to remove it. None oE these things were <br />authorized and wouldn't have been and the only reason I'm telling you all <br />this is to help you to be able to make a decision in the future with out <br />costing you alot of money to either undo or correct, or court costs even, <br />should thatever become necessary. <br />
