. <br /> ( � <br /> PLANNING DIRECTOR DETERII�NATION <br /> Review Process I A�99-017 <br /> June 4, 1999 <br /> The City of Everett Planning Director grants approval of a request by Ron and Nancy <br /> Migas to reduce the standard 100 foot wide wetland buffer from t6e shoreline edge of Silver <br /> I,ake to 50 feet on a vacant site, Lot S, between 1710 & 1720 Silver I.eke Road with the <br /> following conditions: <br /> 1. Enhance the remaining 50 feet of buffer as required by ihe City of Everett's biologist. <br /> The required planting list is attached. <br /> 2. Provide an assurance device worth 3009b of the cost of planting the buffer prior to <br /> issuance of the building permit application. <br /> 3. Provide a recorded Environmentally Sensitive Area Protective Covenant protecting the <br /> buffer. <br /> 4. Provide the City of Everett Planning Departrnent a five yeaz assurance device worth 90% <br /> of the cost of planting the buffer once the buffer planting is completed.. <br /> Subsection 37.100.D of the City of Everett Zoning Code gives the Planning D'uector the <br /> authority to reduce the 100 foot buffer from a Category I wetland (Silver Lake) by up to 509b <br /> when there has been substantial legal alteration of the wedand's buffer and the remaining buffer <br /> is enhanced sufficiently to unprove the functional values of the buffer. <br /> The Planning Director approved the reduced buffer based upon the following: <br /> 1. The buffer was cleared prior to 1990. The buffer consists primazily of grass, a few <br /> shrubs, and some bamboo. <br /> 2. The enhancement plan will improve the functional values of the buffer. The proposal <br /> includes removing nonnative, invasive plants and revegetating the remaining buffer <br /> with native vegetation. <br /> The Planning Director's determination may be appealed. Any such appeal must be filed within <br /> fourteen calendar days of the date specified below. Appeal forms aze available from the <br /> Planning Department and must be submitted along wit6 the required filing fee.
