1. Ap,reement. Recitals. <br /> A. Thc Owncr is the owner of certain real property located in Snohomish <br /> County, Washir.gton ("Property"), within the Urban Gro�vth Area of the <br /> Cit,y, Icgally described as set forth in 8xhioit A attached hereto and <br /> incorporated hcrein by this referencc. <br /> B. The Properiy is not currently within the city limits oF the Ciry ("City <br /> Limits"). <br /> C. Thc Owner desires to connect the Prop�ri)' to thc City's water and/or <br /> sewer utility system ("City System"). <br /> 3. Titic. 7'he Owncr warrnnts that the Owr�er is thc owncr of thc Property and is <br /> authorized to cntcr into this Agreement. <br /> 4. L'xtension Authorizcd — Citv's Ordinances, Rc�:ulations and Policics. Thc Ciry <br /> hcreby authorizcs thc Owner to extend servicc to thc Property. The Owner hereby agrces to <br /> comply �vith, be bomid by and be subject to thc City's ardinances, regulations and policies <br /> conccrning such scrvicc. <br /> 5. Construction. Promptly aftcr execution of this F.grecmcnt, the O�vner shall <br /> submit to thc City a schedulc for design and constniction of the extension to the Property and <br /> any City-required capital facilitics associated there�vith, including without limitation water and <br /> sc�vcr main lines and pump stations (collectivcly, "Gatcnsion"). Whcn the O�mer makes <br /> changcs in thc schcdulc, thc Owncr shall submit updatcs of the schedule to the City. Thc City's <br /> PuUlic Utilities llirector shall tcview and approve in �vriting the plans, specifications and <br /> drnwings of thc C-�tension beforc construction commences. All construction of the Gxtension <br /> shall be complcted in accordance with City stand;vds now existing or as hereafler amended. The <br /> Owner shall permit the City to inspcct the construction and installation of the Lxtcnsion at any <br /> time beforc connection is made to the City System. The City may reject any construction and <br /> installation not confonning to thc approved design of the Gxtcnsion and the requirements of this <br /> Agreement. <br /> 6. Pcrmits, Gascments and Licenscs. The Owncr shall secure and obtain at the <br /> O�vner's sole cost and ezpensc any neccssary perniils, casements and licenses to construct the <br /> Lxtension, including without limitation all necessary easements, excavation pennits, street use <br /> - 1 - <br /> �pp;arq]m <br /> V <br />
