Property may be different trom those applicable prior to the effective date <br /> of annexation; <br /> E. The Property may be subject to and a pnrt of the City's Comprehensive <br /> Plan, which may difFer from that in effect prior to the effective date of <br /> annexation; <br /> P. Zoning and land use regulations applicable to the Property after <br /> anncxation may be different from those applicable to the Property prior to <br /> annexation; and <br /> G. All or any portion of the Properiy may be annexed and the Property may <br /> Ue anncxed in conjunction with, or at the same time as, other property in <br /> the vicinity. <br /> With full knowledgc and understanding of thc consequences of annexation and with full <br /> knowledge and undcrstanding of the Owner's decision to forego opposition to annexation of the <br /> Properiy to the Ciry, the Owncr agrees to sign a petition for annexation to thc City of the <br /> Property as provided in RCW 35.13.130, as it now exists or may hereafter bc amended, 1t such <br /> timc as thc Owncr is rcyucstcd Uy thc City to do so. Thc Owncr also agrces and appoints thc <br /> Mnyor of thc City as thc Uwncr's attomcy-in-fact ro exccutc an annexation petition on the <br /> Owncr's bchalf in thc event that thc Owncr shall fail or refuse to do so and agrees th:it such <br /> signature shall constitutc full aulliority from thc O�mer for anncxation as if the Owner had <br /> signed Ihe petition. If thc O�vner is a corporation, this Agreement shall be executed by an officcr <br /> auihorizcd to exccute dceds or encumbrances on behalf of ihe Owncr, and there shall be aitached <br /> to this Agrccmcnt as Gxhibit B a ccrtificd excerpt from the bylaws of the Owner showing such <br /> authority. <br /> \Vith full knowledge and understanding of the Owner's right to: <br /> A. Noticc of a public henring on the annexation of thc Property to thc City; <br /> and <br /> 13. Appear at such public hearing and voice disapproval of the annexation; <br /> The O�vncr waives thesc rights and further agrees not to litigalc, challenge or in any manner <br /> contest, annexation to the City. This Agrcement shall be deemed to be continuing, and if the <br /> Owner's properry is not anncxed for �vhatcvcr rcason, including a decision by the City not to <br /> annex, the Onmcr agrecs to sign any and all subsequcnt petitions for annexations and agrees not <br /> to litigate, challengc or in any manner contcst any such subsequcnt annexati�n to the Cil.y.
