P�e�r���t—c�i � <br />:;ix•-� <br />USE PERMIT DECISION <br />PACIFIC TOPSOILS <br />USE#10•002 <br />Applicant: Pacific Topsoils <br />805 80'" Street SW <br />Everett, WA 98203 <br />Location: Smith Island (APN 29050800100100) <br />Zoning: M-2 Heavy Manufactu�ng <br />Project Description: The request is for approval of a seven foot thick cap over a former <br />sludge disposai area. A stortnwater coilection trench surtounds the filled area, directing <br />water to the west into the existing wastewater treatment lagoon. No uses or activities <br />other than installing the cap are proposed. Most of the cap is within unicorporated <br />Snohomish County. <br />FINDINGS: <br />Based on the following findings, and subject to conditions of approval listed below, the <br />proposal is found to comply with the pertinent Ciry regulations. <br />1. This decision is based on a six page plan set prepared by Golder Associates with an <br />issued date of January 28, 2010. <br />2. The property is zoned M-2 heavy industrial. No uses are proposed at this time. <br />3. Most of Smifh Island is within shoreline jurisdiction except for certain areas that are <br />above the 100 year (lood piain, inciuding the present site. <br />4. The site covers roughly 13 acres, less than 2090 of which is within the City of Everett <br />and covered by ihis permit. <br />5. Snohomish County Planning and Development Services, acting as lead agency for <br />�his proposal, issued a Delertnination of Non-Significance on March B, 2010. The <br />adminisirative appeal period on that determination expired on March 29, 2010. <br />6. The site has historically been used as a sludge pond. The cap will prevent <br />contaminant from being released fnto surface waters, and groundwaters are being <br />monitored to meet the requirements of the Department of Ecology and Snohomish <br />Health District. <br />DECISION: The City of Everett Planning Director hereby approves use permit to <br />construcl the soild cap as depicted on ihe referenced plan sel. This approval is subject to <br />meeting the following conditions: <br />1. A City of Everett Public Works Pertnit is required for the portion of this project within <br />Everett city limits. Delailed drawings in accordance with City Design and Construction <br />Standards shail be submitted to lhe Public Works Department, showing utilities, storm <br />
