PORT OF EVERETT <br />UMON SLOUGH MARSH MIT[GATION <br />Final Insvection: <br />SECt'[ON 00700 <br />GENERAL CONDITIONS <br />l4. I 1 Upon written notice from COIVTRACfOR that the Work is compkte, ENGINEER will make <br />a final inspection with PORT and CONTRACfOR and will notify CONTRACTOR in writing of all <br />particulars in which this inspection reveals that [he Work is incortrolete or defective. CONTRACTOR <br />shall invnediately take such measures as are nxessary to remedy such deficiencies. <br />Final�pGcation for Pavrnent: <br />14.12 After CONTRACTOR has compkted all such corrections to the satisfaction of ENGINEER <br />and deGvered all maintenance and operating instructions, scheduks, gnazantees, Bonds, certificates of <br />in.pection, mazked-up record documents and other docurt►ents -- all as required by the Contract <br />Documents, and after ENGINEER has indicated that the Worlc is acceptable (subject ro the <br />provisions of paragraph 14.16), CONTRACTOR may meke applicatio� for 5nal payment following <br />the procedure for progress pa�m�ents. The 5na1 Applicr.t:on for Paymrnt shall be accompanied by all <br />documentation called for in the Contract Documents and such other daea and schedules as <br />ENGINEER may reaaon- ably requ'ae, rogether with cortg�kte and kgally effective releases or <br />waivers (satisfactory to POR'i� of all Liens arising out of or filed in connection with the Work. In <br />Geu thereof and as approved by PORT, CONTRACfOR may fiunish receipts or releases in full; an <br />affidavit of CONTRACTOR that the releases and receipts include all labor, services, material and <br />equipment for which a Lien could be filed, and that all payrolls, material and equipment bills, and <br />other indebtedness connected with the Work for which PORT or his property might in any way be <br />responsible, have been paid or otherwise satis5ed; and consent of the Surety, if any, to final payrtent. <br />If any Subcontractor, manufacturer, fabricator, supplier or distributor faiLs to fumish a release or <br />rrceipt in full, CONTRACI'OR may fumish a Bond or other collateral satisfactory to PORT to <br />indemni�: PORT against any Lien. <br />Final Payment and Accgytance: <br />14.13 If, on the basis of ENGINEER's observation of the Work during construction and final <br />inspection, and ENGINEER's review of the 5na1 F.ppGcation for Payrt�ent and accortg�anying <br />documentation -- all as required by the Contract Docurt►ents, ENGINEER is satisfied that the work <br />has been completed and CONTRACTOR has ful5lled all of his obligations with regard to <br />construction of the Project under the Contract Documents, ENGINEER will, within ten days afta <br />receipt of the final Application for Payment, indicate in writing his recomriendations of payment and <br />present the Application to PORT for payment. Thereupon ENGINEER will give written notice to <br />PORT and CONTRACTOR that the Work is acceptable subject to the provisions of pazagraph 14.16. <br />Otherwise, ENGINEER will retum the Application to CONTRACTOR, indicating in writing the <br />reasons for refusing to reco�ttt►xnd final payment, in which case CCIV1'RACI'OR shall make the <br />necessary corrections and resubmit the AppGcation.
