PORT OF EVERETT UNION SLOUGH MARSH MITIGAT[ON ',tf i�� SECTION 00700 GENERAL CONDIT[ONS 14.10 Use by PORT of compkted portions of the Work may be ac�omplished prior to Substantial C�mpktion of all the Work subjcct to the foUowing: 14.10.1 PORT at any t'une may request Ct?IV7'RACfOR in writing to pertnit PORT to use any part of the Work which PORT believes to be substantially compkte and which may be so used without significant interhtence with construction of the other parts of the Work. ff CONTRAC'COR agrees, CONTRACTOR wil! certify to PORT and ENGIIVEER that said part of the Work is substentially compkte and request ENGiNEER to issue a arti5cate of Substantial Compktion for that part of the Work. Within a reasonabk time thereafter PORT, CONCRACTOR and EN(3INEER shall rtnke an inspection of that part of the Worlc to detemwro its status of eompktion. ff ENGIIVEER does not consider that pa�t of the Work to be substantielly compkte, ENGINEER will notity PORT and CON7'RACfOR in writing giving his reasons therefor. If ENaINEER consir�ers that part of the Work to be substantially compkte, ENGINEER will execute and deliver to PORT and CON7RACTOR a certificate to that effect, 5xing the date of Substantial Compktion as to that part of the Work, attaching thento a tentadve list of iturtc to be compkted or cortxtcd before 5na1 payment. Prior to issuing a arti5cate of Substantial Compktion as to part of the Work ENGINEER will deliver to PORT und CONTRACI'OR a written recomrtiendation as to the division of responsibilities pending final payment between PORT and CONTRACTOR with rospect to security, operation, safiety, maintenance, utilities end insurance for that part of the Work which shall become binding upon PORT and COIVTRACTOR at the tirt�e of issuing the de5nitive certi5cate of Substantial Completion as to that part of the Work unkss PORT and CON'fRqCTOR shall have othecwise agrad in writing and so inforned ENGINEER. PORT shall have the right ro exclude CONTRACTOR from any part of the Work which EN(3INEER has so certi5ed to be substantially complete, but PORT shall allow CONTRACCOR nasonabk aecess to compkte or correct items on the tentative list. 14.10.2 In lieu of the issuance of a certi6cate of Substantial Cort4btion as to part of the Worlc, PORT may take over operation of a facility constituting part of the Work whether or not it is substantially comp.kte if such facility is functionally and sepazately usabk; provided that prior to any such takeover, PORT and CONTRACTOR have agrad as ro the division of responsibilities between PORT and CONTRACTOR for security, operation, safety, rt�aintenance, corrxaon period, heat, utilities and insurance with respect te such facility. 00700-47
