PORT OF EVERETT Section 00100 <br />UNION SLOUGH MARSH MITIGATION Instructions to Bidders <br />I <br />1, <br />ARTICLE 1- DEFINITIONS <br />1.1 All defu�itions set forth in General Conditions of the Convact, or other defvtitions within <br />the Contract Documents are appGcable to the Bidding Documents. <br />ARTICLE 2- QUALIF/CAT/ON OF BIDDERS <br />2.1 The OWNFR requ'ves that all bidders be qualified, and have sufficient experience to <br />perform the work. The OWNER may make such investigations as it damc necessary to <br />deterntine the ability of the Bidder to perform the Work. The Bidder shall fumish to the <br />OWNER all such information and data for this purpose as the OWNER may request. The <br />OWNER reserves the right to reject any Bid if the evidence subrttitted by, or investigation <br />of, such Bidder faiLs to satisfy the OWNER :hat such Bidder is properly qualified to carry <br />out the obligations of the Contract and to complete the Work contemplated therein. <br />Each Bid must contain evidence that a bidder is Gcensed and registered as a Conaactor in <br />accordence with the laws of the state of Washingto�. <br />ARTICLE 3- EXAMINATION OF CONTRACT DOCUMENTS AND SITE <br />3.1 It is the responsibility of each Bidder before submitting a Bid, to (a) eramine the Contract <br />Documents thoroughly, (b) visit the site to become familiar with local conditions that may <br />affect cost, progress, performance or fwnishing of the Work, (c) consider federal, state and <br />local Laws and Regulations that may affect cost, progress, performance or furnishing of the <br />Work, (d) study and carefully correlate Bidder's observations with the Conuact <br />Documents, and (e) notify ENGINEER of all contlicts, ertors or discrepancies in the <br />Convact Documents. <br />3.2 The submission of a Bid will constitute an incontrovertible representation by Bidder tliat <br />Eiidder has complied with evcry requirement of this Article 3, that without exception [he <br />Bid is premised upon performing and fumishing the work required by the Contract <br />Documents and such rrxans, methods, txhniques, sequences or procedures of construction <br />as may be indicated in or requ'ued by the Contract Documents, and that the Contract <br />Documents aze sufficient in scope and detail to indicate and convey understanding of all <br />terms and conditions for performance and fiunishing of the work. <br />ARTICLE 4- INTERPRETATION AND ADDENDA <br />4.1 All questions about the meaning or intent of the Contract Documents aze to be d'vected to <br />the ENGINEER. [nterpretations or clarifications considered necessary by the ENGINEER <br />in response to such questions will be issued by Addenda mailed or deGvered to all parties <br />recorded by the OWNIER as having received the Bidding Documents. Questions received <br />less than ten days prior to the date for opening of Bids may not be answered. Only <br />
