PORT OF EVERETT <br />11NION SLOUGH MARSH MI7'IC3ATION <br />ART[CLE 12 - CHANGE OF TEiE CON7'RACT TIME <br />SECTION 00700 <br />GENERAL CONDITTONS <br />12.1 The Contract Time may only be chenged by a Change Orda. My reyueu for an extension in <br />the Contract Time shall be bPsed on written notice delivered to PORT ud ENGINEER within fiftan <br />days of the occurrence of the event giving tise to the request. Notice of the extent of the roquest with <br />supporting data shall be delivered within forty-five days of such occurnnce unkss ENGINEER <br />allows an additional petiod of time to ascertain more accurate data. All requests for adjustment in the <br />Contract Time shall be detemrined by ENGINEER if PORT and CONTRACfOR cannot othecwise <br />agree. My chanqe in the Contract Time resuhing from any such request shall be incorporated in a <br />Change Order. <br />12.2 The Contract Time will be extended in an art►ount a�ual, to time lost due to delays beyonC the <br />conaol of COIV1'RACTOR if a request is msde t}ierefor as provided in paragraph 12.1. Such delays <br />shall include, but not be limited to, aca or negkct by PORT or others performing additional work as <br />contemplated by Article 7, or to fires, floods, labor disputes, epiderttics, abqomrel weatt�er conditions, <br />or acts of God. <br />12.3 All time limits stated in the Contract Documents are of thc essence of the Agteement. The <br />provisions of this Artick 12 shall not exclude recovery for damages (including compensation for <br />additional professional services) for delay by either party. <br />END ARTICLE 12 <br />
