PORT OF EVERETT SECi'ION 00700 UNION SL �UGH MARSH MIT[GATION GENERAL CONDITIONS ARTICLE 13 - WARRANTY AND GUARANTEE; TESTS AND IIVSPECTIONS; CORRECfION, REMOVAL OR ACCEPTANCE OF DEFECCIVE WORK Warrantv and Guazantee: 13.1 CONTRACTOR warrants anci guarantees to PORT and ENGINEER that all Wcrk will be in accordance with the Contract Documents and will not be defective. Prompt notice of all dofxts shall be given to L'ONTRACfOR. All defective Work, whether or not in place, rnay be rej�xted, corrected or accepted as provided in this Article 13. Access to Work: 13.2 ENGINEER and ENGINEER's reprosentatives, other representatives of PORT, testing agencies and governmental agencies with jurisdictional interests will have access to the Work at reasonable times for their observation, inspection and testing. CONTRACfOR shall provide proper and safe conditions for such access. Tests and Ins tions: 13.3 CONTRACTOR shall give ENGINEER timely notice of readiness of the Work for all requfred inspections, tests or approvaLs. 13.4 If any law, ordinance, rule, regulation, code, or order of any public body having jurisdiction requires any Work (or part thereo� ro specifically be inspected, tested or approved, COIVTRACfOR shall assume full responsibility therefor, pay all costs in connection therewith and fumish ENGINEER the required certificates of inspection, testing or approvaL CONi'RACfOR shall also be responsibk fur and shall pay all costs in connection with any inspection or testing required in connecdon with PORT's or ENGINEER's acceptance of a manufacturor, fabricator, supplier or distributor of materials or equipment proposed to be incorporated in the Work, or of materials or equipment submitted for approval prior to CONCRACTOR's purchase thereof for incorporation in the Work. The cost of all other inspections, tests and approvals requ'ved by the Contract Documents shall be paid by PORT (unless otherwise specified). 13.5 All inspections, tests or approvals other than those requirtd by law, ordinance, rule, rogulation, code or order of any public body having jurisdiction shall be perfomrd by organizations acceptable to PORT and CONTRACTOR (or by ENGINEER if so speciSed). 13.6 If any Work that is to be inspected, tested or approved is covered without written concutnnce of ENGINEER, it must, if requested by ENGINEER, be uncovered for observation. Such uncovering shall be at CONTRACTOR's expense unkss CONTRACTOR has given ENGINEER timely notice of CONTRACTOR's intention to cover such Work and ENGINEER has not acted with reasonable promptness in response to such notice. 00700-41
