PORT OF EVERETT SECTION 00?00 UMON SLOUGH MARSH MITIGATTON GENERAL CC�NDITIONS 14.7.4 PORT has been required to correct defective Work or cortyrlete the Work in accordance with paragraph 13.13, 14.7.5 of CONTRACTOR's unsatisfactory prosecution of the Work in accordance with the Contract G�ocuments, 1�.7.6 CONTRACTOR's failurc to make payrtent to Subcontractors, or for labor, materials or equipment, or 14.7.7 of quantity adjustment or correction. Substantial Completion• 14.8 When CONTRACTOR considers the entire Work rca�y for its intended use CONTRAC'I'OR shall, in writinq to PORT and ENGINEER, certify that the entire Work is substantially cor►�lete and request that ENGINEER issue a certi5cate of Substantial Cort�letion. Within a reasonabk time thereafter, PORT, CONTRACTOR and ENGINEER shell malce an inspection of the Work to determine the status of completion. If ENGINEER does not consider the Work substantially complete, ENGINEER wID notify CONfRACTOR in writing giving his roasons therefor. If ENGINEER considers the Work substantially corr�kte, ENGINEER will prepare and deliver to PORT a tentative cert'il'icate of Substantial Compktion which sha115x the date of Substantial Completion. Thero shall be attached to the cerci5cate a tentative list (punch list) of items to be completed or corrected before final pa}mient. PORT shall have seven days after receipt of the tentative certificate during which he may make written objection to ENGINEFR as to any provisions of the certificate or attached list. If, after considering such objections, ENGINEER concludes that the Work is not substantially cort�kte, ENGINEER will within fourteen days after subrtucsion of the tentative certificate to PORT notify CONCRACi'OR in writing, stating his reasons therefor. If, after consideration of PORT's objections, ENGINEER considers the Work substantially cort�kte, ENGINEER will within said fourtan days execute and deliver to PORT and COIVT(tpCTOR a defutitive certificate of Substantial Compktion (with a revised tentative list of items to be completed or corrected) reflecting such changes [rom the tentative certificate as he believes justified after consideration of any objections from PORT. At the time of delivery of the tentative certi5cate of Substantial Co►r�ktion ENGINEER will delive� to PORT and CONTRACfOR a written recommendation as to division of responsibilities pending finai payment betwan PORT and CONTRACTOR with respect to security, operation, safety, rr�aintenance, heat, utilities and insurance. Unless PORT and CONTRACTOR agree othenvise in writing and so inform ENGIIYEER prior to his issuing the definitive certificate of Substantial Cort�letion ENGIIVEER's aforesaid recortm�endation will be binding on PORT and CONTRACTOR until final payrnent. 14.9 PORT shall have the right to exclude CONTRACTOR from the Work after the date of Substantial Completion, but PORT shall allow CONTRACTdR reasonable access to compkte or correct items on the tentative list.
