PLANNING DIRECTOR DETERMINq110N <br />� R�vNw Proca� II N,00-014 . <br />INTRODUCTION: The City of Everett Plann(ng Departrnent has rebeived an applicatbn from <br />Richard Heard, 5006 Sunset Lsne, Everett, WA 98203, to preserve an existinp sa foot (8') high <br />fence within the front yard setbadc. Sectlon 39.O70.A.1 grants the Pianning Director fhe abil(ty to <br />pertnR a fence to exceed the maximum allowable haight of forty-lwo inches (42') wifhin the iront <br />yard setback. , <br />BACKGROUND: Section 39.070.A.1 stetes that fhe maximum height of fences located wifhin fhe <br />iront yard setbeck shall not exceed forty-two inches (42'), unless approved by the Planning <br />Director using Review Process II. <br />The subject property is located at 5008 Sunset Lane, in the R-1, Singie Family Defached Low <br />Density Zone. The owner has made application for a fence maiificatbn for an exbHng six-foot <br />(6') high fence, which is �ocated within the front yard setback. <br />FINDINGS: The fence was conshucted some tlnitl bock at a height that exceedeC thc hat�h: <br />allowed by the Zoning Code. The Cit�s Cade Compllance O}flce received a complaint <br />conceming the fence prior M the applicant owning the home. The applicant roceNpd the code <br />violatlon citation two weeks after ownership was esteblished. The applicanticurtent awner hae <br />sought a fence modificatlon for the exisdng aix-foot (8') high fence. <br />DECISION: The Planning Director hes determined to approve the application for the fence <br />motlificatlon with the following conditions: <br />• A vision triangle must be created on site in order to provids a safe s(ght distence for <br />pedestrian and vehicle operatoF. In order ro axompliah thfn, a portlon of the exiatlng <br />fence must be relaated. This viabn triangb must be crea0ed by romoving a 15' sectlon <br />of fence along both the driveway and U�e street irontage. The fenoe ear lhen be <br />connected together by installing a fence on the diagonal that would connect the lwo points <br />at whfch the fence was romoved. Appeal forms are available from the Pianning Department and muat be submitted along <br />with the required filing fee.
