PLANNING DIRECTOR DETERMINqTION ._. . <br />� ' Review Process II A'00-014 <br />INTRODUCTION: The City of Everett Planning Departrnent has rocefved an applii <br />Richard Heard, 5006 Sunset Lane, Everett, WA 98203, to preserve an existing six foot (8') hi�h <br />fence within the front yard setback. Sectlon 39.070.A1 grants the Planning Director the ability to <br />permit a fence to exceed the maximum allowable height of forty-lwo inahes (42') within the front <br />yard setback. <br />BACKGROUND: SecNon 39.070.A.1 states that the maximum height of fences Iocated within the <br />hont yard setback shall nat exceed forty-two inches (42'), unless approved by the Planning <br />Director using Review Process II. <br />The subject property is located at 5C06 Sunset Lane, in the R-1, Single Family Detached Low <br />Density Zone. The owner has made applicatlon for a fence modification for an exisdng six-faot <br />(6') high fence, which is located within the hont yard setback. <br />FINDINGS: The fence was conshucied some tlmu becic at a h�Ight that exceedsd Lhe ha;gh; <br />allowed by the Zoning Code. The City's Code Compliance Office received a complaint <br />conceming the fence prior to the applicant owning the home. The applicant receivad the code <br />violation citation two weeks after ownership was eshablished. The applicanUcurrent owner has <br />sought a fence modificatlon for tlie exisGng six-foot (6') high fence. <br />DECISION: The Planning Direcror has detertnined to approve the application for the fence <br />modificallon with the following conditions: <br />• A vision triangle must be created on site in order to provide a safe sight distance tor <br />pedestrian and vehicle operetors. In order to accomplish this, a portlon of the exisdng <br />fence must be relocated. This vision triangla must be created by romoving a 15' secdon <br />of fence along both the driveway and the street frontage. The fence can then be <br />connected together by installing a fence on the diagonal that would connect the hvo points <br />at which the fence was removed. Any such appeal must be filed within fourteen (14) calendar days of the date specified <br />below. Appeal forms are available from the Planning Department and must be submitted aiong <br />with the required filing fee.
