2 Exhibit I <br /> Payment Upon Termination of Agreement <br /> By the Agency Other Than for <br /> Fault of the Consultant <br /> (Refer to Agreement, Section IX) <br /> Lump Sum Contracts <br /> A final payment shall be made to the CONSULTANT which when added to any payments previously <br /> made shall total the same percentage of the Lump Sum Amount as the work completed at the time of <br /> termination is to the total work required for the PROJECT. In addition,the CONSULTANT shall be paid <br /> for any authorized extra work completed. <br /> Cost Plus Fixed Fee Contracts <br /> A final payment shall be made to the CONSULTANT which when added to any payments previously <br /> made, shall total the actual costs plus the same percentage of the fixed fee as the work completed at the <br /> time of termination is to the total work required for the Project. In addition,the CONSULTANT shall be <br /> paid for any authorized extra work completed. <br /> Specific Rates of Pay Contracts <br /> A final payment shall be made to the CONSULTANT for actual hours charged at the time of termination <br /> of this AGREEMENT plus any direct nonsalary costs incurred at the time of termination of this <br /> AGREEMENT. <br /> Costs Per Unit of Work Contracts <br /> A final payment shall be made to the CONSULTANT for actual units of work completed at the time of <br /> termination of this AGREEMENT. <br /> 13 <br /> DOT Form 140-089 EF Page 31 <br /> Revised 6/05 <br />
