, <br /> violation of any of the provisions of this code. <br /> Further, this waste water is being pumped out of the crawl space and into an adjacent <br /> surface water system. This is a violation of Everett Municipal Code 14.56.010(B) <br /> which reads; <br /> It is unlawful for any person to throw, drain, run or otherwise discharge into the <br /> surface water system, or to cause, permit or suffer to be thrown, drained, run, <br /> allow to seep or otherwise discharge into the surface water system any organic or <br /> inorganic matter that shall cause or tend to cause pollution of such waters, as <br /> provided for in this section. <br /> This structure has been found to he unfit for human occupancy. The structure is <br /> therefore CONDEMNED. It is to be vacated within 10 days, or by September 14, <br /> 2015 if the proper required corrections are not completed. Placards notifying the <br /> occupants will be posted at the property. Failing to obey the notice of condemnation <br /> may result in criminal charges being filed against the person(s) responsible. <br /> Any legal tenants must be removed in full compliance with all provisions of the <br /> Washington State Landlord-Tenant Act, RCW 59.18. <br /> 5. Corrective Action, Deadline <br /> If the Respondent completes the following corrective action by the date listed below, <br /> and is not a repeat violator, the respondent may enter into an agreed order as <br /> described in Section 7 below. <br /> a. Cease any pumping of fluid from beneath the structure, until an plan has been <br /> approved by the Everett City Public Works Department to provide for the <br /> lawful discharge of the fluid into an approved location. <br /> b. Apply for and obtain a permit from the Building Department to bring the <br /> structure into compliance with the Everett Municipal Code. Complete the work <br /> required and have the work inspected and approved. <br /> The corrective actions must be completed by September 14, 2015. <br /> 6. Hearing Date, Time & Location <br /> Unless Respondent has entered into a stipulated agreement in accordance with Section <br /> 7, a hearing before the Violations Hearing Examiner will be held on: <br /> Unit•3002 Wetmore Ave•Everett, <br /> Everett Police Department,Code Enforcement WA 98201 •425-257-8560 <br />
