<br /> The SR99/Evergreen Way/Rucker Street corridor is a high priority corridor that
<br /> connects five cities and two counties. In recent years, traffic congestion in the
<br /> corridor has become a serious and growing problem. Swift will run along the
<br /> Participating Percentage SR99 corridor from the Aurora Village Transit Center to Everett Station. The
<br /> 89% project will eliminate the service gap to downtown Everett and improve the
<br /> person-carrying capacity and transit service quality along the corridor.
<br /> This grant will provide funding to design and construct the northern terminal at
<br /> Maximum Amount Authorized Everett Station for Community Transit's SR 99 (Swift) Bus Rapid Transit line.
<br /> The preferred location is adjacent to Everett Station at 33rd Street between
<br /> $1,989,823.00 McDougall and Smith Avenues. An alternate site located on 32nd Street
<br /> between McDougall and Smith Avenues is also under consideration. The work
<br /> will include reconfiguring the existing roadway, sidewalk, landscaping and
<br /> utilities at the existing site to accommodate a new transit terminal consisting of
<br /> Project Number 2-4 BRT bus bays, bus shelter, lighting, landscaping, real-time bus arrival signs,
<br /> off-board ticket vending machines and other station amenities to support the
<br /> 2007-B-RMG-011 new BRT.
<br /> This AGREEMENT is made and entered into between the STATE OF WASHINGTON,Department of Transportation,hereinafter called the"STATE,"
<br /> and the above named organization,hereinafter called the"AGENCY",collectively referred to as the"PARTIES"and individually referred to as the
<br /> "PARTY".
<br /> WHEREAS, pursuant to RCW 47.01.330 the Office of Transit Mobility,hereinafter referred to as the OTM,was established within the STATE to
<br /> maximize opportunities to use public transortation to improve the efficiency of transportation corridors;
<br /> WHEREAS, pursuant to RCW 47.66.030 a regional mobility grant program has been established to aid local governments in funding projects such as
<br /> intercounty connectivity service,park and ride lots,rush hour transit service,and capital projects that Improve the connectivity and efficiency of our
<br /> transportation system;
<br /> WHEREAS, pursuant to RCW 47.66.040 the department shall select projects based on a competitive process consistent with local,regional,and state
<br /> transportation plans,local transit development plans and local comprehensive land use plans;
<br /> WHEREAS, pursuant to chapter 44.48 RCW the Legislative Evaluation and Accountability Program(LEAP)Committee provides analysis and
<br /> monitoring of state agency expenditures,budgets and related fiscal matters and consults with legislative committees;
<br /> WHEREAS, pursuant to the Conference Committee Report for Engrossed Substitute House Bill 1094,Laws of 2007 at Section 224(4)the legislature
<br /> appropriated funds from the STATE multimodal transportation account for the regional mobility grant projects selected by the STATE and as set forth in
<br /> the LEAP Transportation Document 2007-B,2007-2009 Regional Mobility Grant Program as developed April 20,2007;
<br /> WHEREAS,the AGENCY is planning the work shown in the caption space above,and in connection therewith,the AGENCY has requested financial
<br /> assistance for the project or program;and
<br /> WHEREAS,the AGENCY has requested funds for the above shown project or program,which has been selected by the STATE as a project for
<br /> funding assistance to be provided as set forth in the LEAP Transportation Document 2007-B,2007-2009 Regional Mobility Grant Program as
<br /> developed April 20,2007.
<br /> NOW THEREFORE,in consideration of the terms,conditions,covenants, and performances contained herein,or attached and
<br /> incorporated and made a part hereof, IT IS MUTUALLY AGREED AS FOLLOWS:
