WHEREAS, increases in demands upon resources of the City in the coming year <br /> to provide services in the areas of fire prevention and suppression, law and <br /> justice, emergency medical, transportation, road repair and maintenance, parks <br /> and recreation, new fire and police communication, safe and clean <br /> neighborhoods, and to fulfill state and federal mandates which are unfunded in <br /> these and other areas such as meeting the requirements of the Endangered <br /> Species Act (15 U.S.C. a1531-1543) require additional financial resources <br /> beyond those permitted utilizing the inflation rate as defined by RCW <br /> 84.55.005(1); <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT as follows: <br /> Section 1. The City Council, of the City of Everett is conducting a series of <br /> budget workshops reviewing the sources of funds for necessary city programs <br /> and services in 1999. <br /> Section 2. The City Council finds there is a substantial need for using the 106 <br /> percent limit factor under Chapter 84.55 RCW ,as amended by Referendum 47, <br /> in setting and attaining the fullest regular property tax levy allowable. The <br /> elements of the substantial need identified by the Everett City Council include, <br /> but are not limited to, providing for the public health and safety as will be <br /> described in the Preliminary 1999 Budget. The finding of substantial need is <br /> further defined as including such increases in demands upon resources of the <br /> City in the coming year to provide services in the areas of fire prevention and <br /> suppression, law and justice, emergency medical, transportation, road repair and <br /> maintenance, parks and recreation, new fire and police communication, safe and <br /> clean neighborhoods, and the need to fulfill state and federal mandates which <br /> are unfunded in these and other areas such as meeting the requirements of the <br /> Endangered Species Act (15 U.S.C. U1531-1543). <br /> Section 3. This finding of substantial need includes both the City General Fund <br /> and the Emergency Medical Services Fund as described in Section 2. <br /> Section 4. This finding of substantial need to use the limit factor of 106 percent <br /> as permitted by Chapter 84.55 RCW is made by a majority plus one vote of the <br /> Everett City Council as required by RCW 84.55.0101 (Chapter 3 1 204 Laws of <br /> Washington 1997; Referendum 47, Q 204) and is embodied in this separate <br /> Resolution as required by RCW 84.55.120 as amended by Chapter 3, 1209 <br /> (Referendum 47, 1209). <br /> Section 5. Based on this finding of substantial need, the limit factor for the regular <br /> property tax levy for the general fund for the calendar year 1999 shall be 6% <br /> which is 106 percent of the highest amount of regular property taxes that could <br /> have been lawfully levied in this taxing district in any year since 1996. <br /> Section 6. Based on this finding of substantial need , the limit factor for the <br /> regular property tax levy for the emergency services for the calendar year 1999 <br /> 2 <br />
