By implementing the land use designation of the Comprehensive Plan,the proposed rezone from B-1 (Neighborhood Shopping)to B-2 (Community Business)bears a substantial relation to public health, safety, and welfare. 3. By making the City Zoning Map consistent with the Land Use Map of the Comprehensive Plan, the proposed rezone promotes the best long term interests of the Everett community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. The property located on the northwest corner of 46th Street and Evergreen Way, which is depicted on the attached Exhibit"A," and which is legally described as follows: Victory Heights Addition to Everett, Block 022, Portion of Lot 10 described as follows: BEGINNING at the northwest corner of said lot, THENCE southerly along the west line 110.50 feet to the southwest corner and THE POINT OF BEGINNING. THENCE angle left 134*0' 21" 83 feet, THENCE angle left 51*16' for 66.60 feet, THENCE angle left 13*01' 33" 23.89 feet, THENCE southeasterly 152 feet to a point on the westerly line of Evergreen Way which bears South 83*38'53"East 155 feet from the northwest corner of said Lot 10, and continuing along the same southeasterly track to the centerline of Evergreen Way, THENCE southwesterly along the centerline of Evergreen Way to the point of intersection of said centerline with the centerline of 46th Street, THENCE westerly along the centerline of 46th Street 232 feet, more or less, THENCE north to the north line of Lot 8 of said Victory Heights Addition to Everett, THENCE easterly along said north line of said Lot 8 to the southwest corner of said lot 10 and THE POINT OF BEGINNING. is hereby rezoned from B-1 (Neighborhood Shopping)to B-2 (Community Business). Section 2. That should any section, subsection,paragraph, sentence clause or phrase set forth in this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 3. It is expressly the purpose of this ordinance to provide for and promote the health, safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this ordinance.
