• <br /> WHEREAS, Remedial Investigation and Feasibility Study (RIFS) work at the City of <br /> Everett landfill/tirefire site has identified some adverse environmental impacts at the City's old <br /> landfill site which might be mitigated and which mitigation the City Council finds is, <br /> historically, an appropriate function of the Solid Waste Management Utility which is necessary <br /> in order that the landfill site continue as,a solid waste disposal site and be available for other <br /> possible solid waste handling activities in the future; and <br /> WHEREAS, to establish the public portion of said waste reduction and recycling and <br /> solid waste programs, to continue City involvement in solid waste management, and to mitigate <br /> the adverse environmental impacts associated with the City of Everett landfill/tirefire site it is <br /> necessary to continue a City of Everett Solid Waste Management Utility and to establish charges <br /> for said service; <br /> WHEREAS, the old City landfill site poses a threat to the environment since leachate <br /> seeps along the east edge of the landfill have been identified and may be adversely affecting the <br /> Snohomish River, and the City has conducted remedial investigations, feasibility studies, risk <br /> assessments, and completed contract documents to correct these problems. <br /> WHEREAS, the corrective actions will require the construction of a leachate collection <br /> system, a cover for the tirefire ash area, a surface water interception ditch and a possible wetland <br /> mitigation. <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The City of Everett Solid Waste Management Utility, as established under <br /> Ordinance 2032-94 shall continue and is authorized to undertake all activities authorized by law <br /> for the construction of the Landfill and Tire Fire Site improvement projects, and for garbage and <br /> solid waste handling including recycling operations and specifically including mitigation of the <br /> old landfill property on 36th Street east of the I-5 freeway; provided that said utility is not <br /> authorized to engage directly in garbage and solid waste collection, except for hard-to-manage <br /> waste and/or city-wide clean-up projects and programs as the Mayor deems necessary to promote <br /> and facilitate waste reduction, recycling and disposal. <br /> Section 2: The Utility shall be under the direct management of the Mayor using such <br /> staff and consultant services as the Mayor deems appropriate.
