under this ordinance regarding the matter of the violation, <br /> penalty and/or the required corrective action; and <br /> 8 . A statement that failure to comply with the terms of the <br /> agreement shall constitute a misdemeanor punishable by a <br /> fine not to exceed one thousand dollars ($1000) per day. <br /> D. An extension of the time limit for correction or a <br /> modification of the required corrective action may be granted by <br /> the code compliance officer if the person responsible for the <br /> violation has shown due diligence and/or substantial progress in <br /> correcting the violation but unforeseen circumstances render <br /> correction under the original conditions unattainable. <br /> E. If the terms of the voluntary correction agreement are not <br /> met, the person responsible for the violation shall be assessed a <br /> monetary penalty commencing on the date set forth in the <br /> correction agreement. Further, a violation of the terms of the <br /> agreement shall constitute a misdemeanor punishable by a fine not <br /> to exceed one thousand dollars ($1000) per day. Citations for <br /> violations of the agreement shall be filed in Everett municipal <br /> court. The City may abate the violation in accordance with the <br /> provisions of this Chapter if the terms of the voluntary <br /> correction agreement are not met. The City is entitled to <br /> recover all costs and expenses of abatement . <br /> Section 2 : Section 2 of Ordinance No. 1383-87, as amended, (EMC <br /> 1 . 20 . 020) which reads as follows : <br /> 1 .20. 020 Applicability. <br /> A. The city administration, upon concurrence of the city <br /> attorney, may file for injunctive or other civil relief in <br /> superior court regarding violations of city ordinances listed <br /> hereafter. Otherwise, the procedure authorized in this Chapter <br /> shall be the enforcement procedure for the following ordinances <br /> and regulations of the City: <br /> 1 . Rubbish (Ordinance 1720, as amended: Chapter 8 .20) ; <br /> 2 . Nuisances (Ordinance 278-74 : Chapter 8 .24) ; <br /> 3 . Obstructing sidewalks (Ordinance 4056, as amended: Chapter <br /> 13. 12) ; <br /> 4 . Driveways (Ordinance 1586, as amended: Chapter 13 . 16) ; <br /> 5. Temporary use of rights-of-way (Ordinance 1048-84, as <br /> amended: Chapter 13 .30) ; <br /> 6. Utility construction permit (Ordinance 227, as amended: <br /> Chapter 13 . 32) ; <br /> 7 . Banners over streets (Ordinance 1932-93, as amended: Chapter <br /> 13 . 40) ; <br /> 8 . Sewer connections (Ordinance 3735, as amended: Chapter <br /> 14 . 08) ; <br /> 4 <br />
